3DETAILED ACTION
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1-2 is/are rejected under 35 U.S.C. 102(a)(1) as being disclosed by Karnell (2,673,425).
Karnell discloses the invention including:
Claim 1; a shaft 16 having a driving end 14 and a driven end (see Fig. 2 where the spindle of the rotary tool connect with the shaft 16), wherein the shaft is provided with a first end face at the driving end, and wherein the driven end is adapted to be directly or indirectly driven by a power tool (rotary tool, see col. 1); a driven member 11 sleeved on the shaft and configured to rotate synchronously with the shaft, and wherein the driven member is provided with a second end face (see Fig. 1); a first grinding body 18 disposed on the first end face (see Fig. 2); and a second grinding body 10 disposed on the second end face (see Fig. 1-2).
Claim 2; wherein the driven member is configured to rotate synchronously with the shaft along a rotation axis, wherein the first end face and the second end face are respectively perpendicular to the rotation axis, and wherein the first grinding body protrudes along the rotation axis beyond the second grinding body by at least a height (see Fig. 2).
Claim Rejections - 35 USC § 103
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
Claim(s) 8 is/are rejected under 35 U.S.C. 103 as being unpatentable over Karnell (2,673,425) in view of Chen et al. (8,753,175).
Karnell discloses the invention substantially as claimed except for the shaft is provided with a first through hole penetrating the driving end and the driven end along the rotation axis, and wherein the first grinding body is provided with a second through hole aligned with the first through hole along the rotation axis. However, Chen et al. teaches the use of a first through hole 103 and second through hole (see Fig. 2) for the purpose of flowing grinding slurry therethrough. It would have been obvious to one having ordinary skill in the art at the time the invention was made to have modified the device of Karnell by providing the above limitations as taught by Chen et al. in order to obtain a device that flow grinding slurry therethrough.
Allowable Subject Matter
Claims 3-7 and 9-13 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
