CTNF 19/005,510 CTNF 75698 DETAILED ACTION Notice of Pre-AIA or AIA Status 07-03-aia AIA 15-10-aia The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA. Claim Rejections - 35 USC § 102 07-07-aia AIA 07-07 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – 07-12-aia AIA (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. 07-15-aia AIA Claim(s) 1-3, 13-15 is/are rejected under 35 U.S.C. 102 a2 as being anticipated by Yamada et al. (U.S. PGPUB 2022/0014700) . Regarding claims 1-3, 13-15, Yamada et al. disclose (Figs. 11A, 11B) a photoelectric conversion element comprising: a semiconductor substrate (1); a first photoelectric converter above the semiconductor substrate, the first photoelectric converter comprising: a first electrode (13); a second electrode (17); a first photoelectric conversion layer (121) disposed between the first electrode and the second electrode; and a third electrode (18) disposed to be opposed to the first photoelectric conversion layer with an insulating layer (8) interposed therebetween; and a second photoelectric converter (PD) disposed in the semiconductor substrate, wherein, in a plan view (see Fig. 11B), each of the first electrode and the second electrode overlaps with the second photoelectric converter. The first electrode transfers charge generated by the first photoelectric converter. Yamada et al. further disclose ([0114]) a signal processor (“signal processing circuit”) and the first electrode and the third electrode are at a same level (located in the same layer level of the device) within the photoelectric conversion element . Allowable Subject Matter 12-151-08 AIA 07-43 12-51-08 Claim s 4-12, 16-20 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
