Office Action

§DP
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Information Disclosure Statement The submission of information disclosure statement (IDS) on 01/09/2025 is in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is being considered by the examiner. Double Patenting The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir. 1985); In re Van Ornum, 686 F.2d 937, 214 USPQ 761 (CCPA 1982); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); In re Thorington, 418 F.2d 528, 163 USPQ 644 (CCPA 1969). A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on nonstatutory double patenting provided the reference application or patent either is shown to be commonly owned with the examined application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. See MPEP § 717.02 for applications subject to examination under the first inventor to file provisions of the AIA as explained in MPEP § 2159. See MPEP § 2146 et seq. for applications not subject to examination under the first inventor to file provisions of the AIA . A terminal disclaimer must be signed in compliance with 37 CFR 1.321(b). The USPTO Internet website contains terminal disclaimer forms which may be used. Please visit www.uspto.gov/patent/patents-forms. The filing date of the application in which the form is filed determines what form (e.g., PTO/SB/25, PTO/SB/26, PTO/AIA /25, or PTO/AIA /26) should be used. A web-based eTerminal Disclaimer may be filled out completely online using web-screens. An eTerminal Disclaimer that meets all requirements is auto-processed and approved immediately upon submission. For more information about eTerminal Disclaimers, refer to www.uspto.gov/patents/process/file/efs/guidance/eTD-info-I.jsp. Claims 1-18 are rejected on the ground of nonstatutory double patenting as being unpatentable over claims 1-18 of U.S. Patent No. 12204863 and claims 1-15 of U.S. Patent No. 11288583. Although the claims at issue are not identical, they are not patentably distinct from each other because both sets of claims are toward detecting a defective/incomplete entigen group within a knowledge database. The defective/incomplete entigen group includes entigens and one or more entigen relationships between at least some of the entigens. The defective/incomplete entigen group represents knowledge of a topic. The method further includes obtaining corrective/additive content for the topic based on the defective entigen group and generating a corrective/additive entigen group based on the corrective/additive content. The method further includes updating the defective/incomplete entigen group utilizing the corrective/additive entigen group to produce a curated/updated entigen group. The only difference between the three sets of claims is the wording of the concept and the use of different terms, such as “incomplete entigen”, “additive content”, and “non-curated status” in the current application versus “defective entigen”, “corrective content”, and curated status, in the current application and the US 12204863 Patent; and also mentioning in the current claim that the claimed steps are used for initiating retrieval augmented generation to retrieve additive content for a topic and generating a neural network representation of the additive content for the topic, which is based on the same steps claimed at the patents, and does not render the claims patentably distinct from each other. Below is an illustration of claim 1 of the current application versus claim 1 of each of the patents. US 12204863 Current Application 1. A method for execution by a computing device, the method comprises: detecting an incomplete entigen group, wherein a knowledge database includes the incomplete entigen group, wherein the incomplete entigen group includes a plurality of entigens and one or more entigen relationships between at least some of the plurality of entigens, wherein the incomplete entigen group represents at least some knowledge of a topic; issuing, via a user interface of the computing device, an additive content query based on the incomplete entigen group; obtaining, via the user interface of the computing device, additive content for the topic based on the incomplete entigen group; determining a set of identigens for each word of a plurality of words of the additive content to produce a plurality of sets of identigens, wherein each identigen of the set of identigens includes a meaning identifier, an instance identifier, and a time reference, wherein each meaning identifier associated with a particular set of identigens represents a different meaning of one or more different meanings of a corresponding word of the plurality of words of the additive content, wherein a first set of identigens of the plurality of sets of identigens is produced for a first word of the plurality of words of the additive content; determining whether the additive entigen group conflicts with the incomplete entigen group; and when the additive entigen group conflicts with the incomplete entigen group: updating the incomplete entigen group utilizing the additive entigen group to produce an updated entigen group with an un-curated status; and outputting, via the user interface of the computing device, a representation of the updated entigen group with an indication of the un-curated status. 1.A neuro-symbolic retrieval augmented generation hybrid method for execution by a computing device, the method comprises: initiating retrieval augmented generation to retrieve additive content for a topic by: detecting an incomplete entigen group that represents at least some knowledge of the topic within a knowledge database, wherein the incomplete entigen group includes a plurality of entigens and one or more entigen relationships between at least some of the plurality of entigen; generating a symbolic architecture representation of the additive content for the topic by further applying the identigen entigen processing approach to the neural network representation of the additive content for the topic, wherein the symbolic architecture representation of the additive content for the topic represents a most likely meaning interpretation of the additive content for the topic, wherein the generating the symbolic architecture representation of the additive content for the topic includes: interpreting, in accordance with identigen pairing rules of the knowledge database, the plurality of sets of identigens to determine a most likely meaning interpretation of the additive content and produce an additive entigen group comprising one or more entigens as the symbolic architecture representation of the additive content, wherein the additive entigen group represents the most likely meaning interpretation of the additive content, wherein each entigen of the additive entigen group corresponds to a selected identigen of a corresponding set of identigens having a selected meaning of the one or more different meanings of each word of the plurality of words, wherein each entigen of the additive entigen group represents a single conceivable and perceivable thing in space and time that is independent of language and corresponds to a time reference of the selected identigen associated with the additive entigen group, wherein the selected identigen favorably pairs with at least one corresponding sequentially adjacent identigen of another set of identigens of the plurality of sets of identigens based on the identigen pairing rules; determining whether the additive entigen group conflicts with the incomplete entigen group; and when the additive entigen group conflicts with the incomplete entigen group: updating the incomplete entigen group utilizing the additive entigen group to produce an updated entigen group with an tun-curated status; and outputting a representation of the updated entigen group with an indication of the un-curated status.
