Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Objections to the claims
Claim 72 needs to be renumbered as claim 71. Appropriate correction is required.
Double patenting
Claims 52-71 are rejected on the ground of nonstatutory double patenting as being unpatentable over claims 1-3; 5-9; 11-13; 15-19 of U.S. Patent No. 11729462 in view of Pearlman . Although the claims at issue are not identical, they are not patentably distinct from each other because the subject matter claimed in the instant application is fully disclosed in the referenced US. Patent and would be covered by any patent granted on that copending application since the referenced US. Patent and the instant application are claiming common subject matter, as follows:
Claim 52 of the current application corresponds to claims 1 and 2 of US. Pat( 11729462).
Claim 53 of the current application corresponds to claim 3 of US. Pat(11729462).
Claim 54 of the current application corresponds to claim 3 of US. Pat( 11729462).
Claim 55 of the current application corresponds to claim 7 of US. Pat(11729462).
Claim 56 of the current application corresponds to claim 9 of US. Pat(11729462).
Claim 57 of the current application corresponds to claim 1 of US. Pat(11729462).
Claim 58 of the current application corresponds to claim 2 of US. Pat(11729462).
Claim 59 of the current application corresponds to claim 5 of US. Pat( 11729462).
Claim 60 of the current application corresponds to claim 6 of US. Pat( 11729462).
Claim 61 of the current application corresponds to claim 8 of US. Pat(11729462).
Claim 62 of the current application corresponds to claims 11 and 12 of US. Pat( 11729462).
Claim 63 of the current application corresponds to claim 13 of US. Pat( 11729462).
Claim 64 of the current application corresponds to claims 13 of US. Pat(11729462).
Claim 65 of the current application corresponds to claim 17 of US. Pat(11729462).
Claim 66 of the current application corresponds to claim 19 of US. Pat( 11729462).
Claim 67 of the current application corresponds to claim 11 of US. Pat(11729462).
Claim 68 of the current application corresponds to claim 12 of US. Pat( 11729462).
Claim 69 of the current application corresponds to claim 15 of US. Pat( 11729462).
Claim 70 of the current application corresponds to claim 16 of US. Pat( 11729462).
Claim 71 of the current application corresponds to claim 18 of US. Pat( 11729462).
As illustrated above, claims1-3; 5-9; 11-13; 15-19 of U.S. Patent No. 11729462 teach the subject matter of the claims 52-71 of the instant application except some limitations of claims 52 and 62 as :
“ in response to detecting the interruption, comparing an attribute of a first profile associated
with the first user with an attribute of the plurality of attributes of the interactive feature;
based on the comparing, determining that the attribute of the interactive feature matches the attribute of the first profile”.
Pearlman (US.Pub.No. 20150382052) et al are from the same field of endeavor as the instant application and the US.Patent.No. 11729462. Pearlman et al in para. 0089-0091; 0094-0095; 0108-0109; 0134; 0033-0035 disclose a system being able to compare attributes or metadata related to user profile with one attribute of multiple attributes of an interactive feature in order to find match between the interactive feature as commercial or advertisement and the user profile.
Thus, it would have been obvious before the effective filing date of the claimed invention to compare attribute of interactive feature with attribute associated with user profile in order to find match among attributes as disclosed by the instant application 19015147 and as taught in para. 0089-0091; 0094-0095; 0108-0109; 0134; 0033-0035 by US.Pub.No. 20150382052 for the purpose of improving viewing experience in recommending category of video contents to users accordingly.
