Office Action

§112
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Remarks This communication is in response to Application No. 19/016,488 filed on 01/10/2025. Claims 1-20 are currently pending and have been examined. Information Disclosure Statement The information disclosure statement(s) (IDS) submitted on 01/10/2025 is/are in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement(s) is/are being considered by the examiner. Drawings The drawings filed 01/10/2025 are acceptable. Claim Interpretation Under 35 USC § 112 No claim elements in this application are presumed to invoke 35 U.S.C. 112(f). Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claim(s) 3, 7-20 is/are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor, or for pre-AIA the applicant regards as the invention. As to claims 3, 7-20 the use of the word “about” when indicating a value, duration, numerical range, location, shape, or comparative sizing or proximity is considered indefinite as the specification or arguments previously presented fails to provide some standard for measuring that degree; and there is no standard that is recognized in the art for measuring the meaning of the term of said degree. It is noted that he specification at [0018] discusses the term “about” but does not provide a standard for measuring that degree. Any reliance on [0018] to rebut this is thwarted by “[0018] As used herein, the term "about" means that amounts, sizes, formulations, parameters, and other quantities and characteristics are not and need not be exact, but may be approximate and/or larger or smaller, as desired …” as the metes and bounds remain unclear. Claims 12-20 are rejected via dependency. Allowable Subject Matter Claims 1-2 and 4-6 are allowed. Claim 11 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action. The following is an examiner’s statement of reasons for allowance: the prior art does not disclose or fairly teach, in addition to the other elements, a speed nock comprising: a first end; a second end; an outer wall; an inner wall opposite the outer wall; at least one relief extending into the outer wall and longitudinally along the outer wall at least a majority of a distance between the ends of the speed nock, wherein the at least one relief is substantially aligned with a longitudinal axis of the speed nock; and a longitudinally-extending gap extending between the first and second ends of the speed nock; wherein the speed nock is deformable between an open configuration where the bowstring may be received through the gap, and a closed configuration wherein the inner wall impinges on the bowstring and prevents the speed nock from moving along a length of the bowstring; and wherein the speed nock is configured to deform from the open configuration to the closed configuration under a radially-applied force. Any comments considered necessary by applicant must be submitted no later than the payment of the issue fee and, to avoid processing delays, should preferably accompany the issue fee. Such submissions should be clearly labeled “Comments on Statement of Reasons for Allowance.” The closest art of record: US 8826896 B1 US 20220252372. Conclusion The prior art made of record on the attached PTOL-892 and not relied upon is considered pertinent to applicant's disclosure as each further discloses a state of the art. The examiner has pointed out particular references contained in the prior art of record in the body of this action for the convenience of the applicant. Although the specified citations are representative of the teachings in the art and are applied to the specific limitations within the individual claim, other passages and figures may apply as well. Applicant should consider the entire prior art as applicable as to the limitations of the claims. It is respectfully requested from the applicant, in preparing the response, to consider fully the entire reference as potentially teaching all or part of the claimed invention, as well as the context of the passage as taught by the prior art or pointed out by the examiner.
