Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claims 1-2, 16-17 and 20 are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Nam et al. (20230092211).
Regarding claim 1, Nam discloses a communication method based on SL positioning assistance information (see abstract, figs.3-4, paragraph [0024-0025] and its description), wherein the method comprises: determining, by a first terminal, first SL positioning assistance information (see abstract, fig.3, fig.4A, element 115a, paragraph [0024-0025], [0068-0070], [0088] and its description); and reporting, by the first terminal, the first SL positioning assistance information to a network-side device (see abstract, fig.3, elements 115a, 105, paragraph [0024], [0068], [0068-0070], [0088] and its description); wherein the first SL positioning assistance information is used for configuring SL positioning required information for the first terminal by the network-side device, and the SL positioning required information comprises at least one of SL positioning assistance data and SL positioning configuration information (see abstract, fig.3, elements 115a, 105, paragraph [0024], [0068], [0068-0071], 16-17 and 20 [0088] and its description).
Regarding claim 2, Nam further discloses wherein the first SL positioning assistance information comprises SL positioning assistance information of one or more related terminals (see abstract, fig.1, element 115i, fig.3, fig.4C, element 115a, step 382, paragraphs [0022], [0024], [0027], [0054], [0090-0093] and its description); wherein the related terminal comprises at least one of the first terminal and a second terminal, and the second terminal comprises at least one of a terminal establishing an SL connection to the first terminal and a terminal performing SL positioning related information transmission with the first terminal (see abstract, fig.1, elements 115i-k, fig.3, elements 115a-b, step 382 fig.4C, elements 115a-b paragraphs [0022], [0024], [0027], [0054], [0090-0093] and its description), wherein the SL positioning related information comprises at least one of an SL positioning reference signals and an SL positioning reference signal measurement result (see abstract, fig.1, elements 115i-k, fig.3, elements 115a-b, step 384, fig.4C, element 115a-bparagraphs [0022], [0024], [0027], [0054], [0088], [0090-0093] and its description).
Regarding claims 16-17 and 20 recite limitations substantially similar to claims 1-2. Therefore, these claims were rejected for similar reasons as stated above.
Allowable Subject Matter
Claims 3-15 and 18-19 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
