Claim Rejections - 35 USC § 103 The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. The factual inquiries for establishing a background for determining obviousness under 35 U.S.C. 103 are summarized as follows: 1. Determining the scope and contents of the prior art. 2. Ascertaining the differences between the prior art and the claims at issue. 3. Resolving the level of ordinary skill in the pertinent art. 4. Considering objective evidence present in the application indicating obviousness or nonobviousness. Claim(s) 6 & 16 is/are rejected under 35 U.S.C. 103 as being unpatentable over Namgoong in view of Brown et al. (US 3,838,316). In regards to claim 6 & 16, Namgoong fails to disclose wherein when the guide groove is viewed from the opening part of the outer case, an edge of the guide groove has a V-shaped planar shape. Brown ‘316 discloses wherein when the guide groove is viewed from the opening part of the outer case, an edge of the guide groove has a V-shaped planar shape (fig. 7). It would have been obvious to one of ordinary skill in the art prior to the effective filing date of the claimed invention to form the guide groove of Namgoong to have a V-shape as taught by Brown ‘316 to provide more leeway in the initial lead insertion during positioning while also allowing for various lead diameters. Furthermore, a change in shape is generally recognized as being within the level of ordinary skill in the art. In re Dailey, 357 F.2d 669, 149 USPQ 47 (CCPA 1966). Claim(s) 1-3, 5, 7, 11-15, 17, & 19-20 is/are rejected under 35 U.S.C. 103 as being unpatentable over Majima et al. (US 2020/0294718) in view of Fanning (US 3,806,766). In regards to claim 1, Majima ‘718 discloses a capacitor comprising: a capacitor element (10 – fig. 1; [0032]) including an element body (40 – fig. 3; [0034]) and an external electrode (41 & 42 – fig. 3; [0034]) on an end surface of the element body; a lead-out terminal (51 & 52 – fig. 3; [0034]) electrically connected to the external electrode; an outer case (20 – fig. 1; [0032]) housing the capacitor element inside so that the lead-out terminal projects outward (fig. 1), the outer case having: a bottomed tubular shape with an opening part at a first end thereof (fig. 1-2), a bottom wall sealing a second end while facing the opening part (fig. 1-2), a side wall projecting toward the opening part from the bottom wall (fig. 1-2), a filling resin (30 – fig. 1; [0033]) filling a space between the capacitor element and the outer case.
