DETAILED ACTION
This non-final rejection is responsive to the claims filed 15 January 2025. Claims 1-20 are pending. Claims 1, 19, and 20 are independent claims.
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Double Patenting
The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir. 1985); In re Van Ornum, 686 F.2d 937, 214 USPQ 761 (CCPA 1982); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); In re Thorington, 418 F.2d 528, 163 USPQ 644 (CCPA 1969).
A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on nonstatutory double patenting provided the reference application or patent either is shown to be commonly owned with the examined application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. See MPEP § 717.02 for applications subject to examination under the first inventor to file provisions of the AIA as explained in MPEP § 2159. See MPEP § 2146 et seq. for applications not subject to examination under the first inventor to file provisions of the AIA . A terminal disclaimer must be signed in compliance with 37 CFR 1.321(b).
The USPTO Internet website contains terminal disclaimer forms which may be used. Please visit www.uspto.gov/patent/patents-forms. The filing date of the application in which the form is filed determines what form (e.g., PTO/SB/25, PTO/SB/26, PTO/AIA /25, or PTO/AIA /26) should be used. A web-based eTerminal Disclaimer may be filled out completely online using web-screens. An eTerminal Disclaimer that meets all requirements is auto-processed and approved immediately upon submission. For more information about eTerminal Disclaimers, refer to www.uspto.gov/patents/process/file/efs/guidance/eTD-info-I.jsp.
Claims 1-20 rejected on the ground of nonstatutory double patenting as being unpatentable over claim 1-20 of U.S. Patent No. 12,236,063 B2. Although the claims at issue are not identical, they are not patentably distinct from each other.

Claim Rejections - 35 USC § 101
35 U.S.C. 101 reads as follows:
Whoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefor, subject to the conditions and requirements of this title.
Claims 1, 4-8, and 13-20 are rejected under 35 U.S.C. 101 because the claimed invention is directed to an abstract idea without significantly more.
Regarding Claim 1
Step 1
According to the first part of the analysis, in the instant case, claims 1-18 are directed to a method, claim 19 is directed to a system, and claim 20 is directed to a non-transitory machine-readable storage medium. Thus, each of the claims falls within one of the four statutory categories (i.e., process, machine, manufacture, or composition of matter).
Step 2A, Prong One
determining how many non-access restricted … experiences a creator of a given … experience has previously submitted; and (This step is for determining the number of experiences and it is practically implementable in the human mind or with the aid of pen and paper; and thus, it is understood as a mental process)
allowing the creator to submit the given … experience in response to determining that a quantity of the non-access restricted … experiences the creator has previously submitted transgresses a threshold. (This step is for determining whether a person may participate in an activity based on their contributions and it is practically implementable in the human mind or with the aid of pen and paper; and thus, it is understood as a mental process. The foregoing may also be understood as a method of organizing human activity.)
Step 2A Prong 2: This judicial exception is not integrated into a practical application.
augmented reality (This element identifies the type of content, which is understood to be a field of use limitation. MPEP 2106.05(h))
Step 2B
The claim does not include additional elements that are sufficient to amount to significantly more than the judicial exception because when considered separately and in combination, they do not add significantly more (also known as an “inventive concept”) to the exception. The claim recites a field of use limitation.
Regarding claims 19 and 20, these claims provide the additional elements of a processor and a non-transitory machine-readable storage medium, which amount to generic computer components under MPEP 2106.05(f). The claims do not include additional elements that are sufficient to amount to significantly more than the judicial exception because when considered separately and in combination, they do not add significantly more (also known as an “inventive concept”) to the exception. The claims recite generic computer components.

in response to determining that the subset includes more than a threshold number of … experiences, allowing a given identifier of the given … experience to be included in a graphical user interface among a plurality of identifiers. (This step is for determining whether the number exceeds an amount and it is practically implementable in the human mind or with the aid of pen and paper; and thus, it is understood as a mental process)

(This step is for selecting the experience based upon a criteria and it is practically implementable in the human mind or with the aid of pen and paper; and thus, it is understood as a mental process)
Step 2A Prong Two:
augmented reality (This element identifies the type of content, which is understood to be a field of use limitation. MPEP 2106.05(h))
Step 2B:
The claim does not include additional elements that are sufficient to amount to significantly more than the judicial exception because when considered separately and in combination, they do not add significantly more (also known as an “inventive concept”) to the exception. The claim recites field of use limitations.
Regarding Claim 13
Step 2A Prong One:
Step 2A Prong Two:
wherein a plurality of identifiers is presented as icons over a given video captured by a device.
(This element focuses on how to display the content, which is understood to be a field of use limitation.
