Claim Rejections - 35 USC § 112
The following is a quotation of the first paragraph of 35 U.S.C. 112:
The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same and shall set forth the best mode contemplated by the inventor of carrying out his invention.
Claims 2-21 (filed 08/19/2025) are rejected under 35 U.S.C. 112, first paragraph, as failing to comply with the written description requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor(s), at the time the application was filed, had possession of the claimed invention.
Claim(s) 1, 8, states that the “…(iv) determining the engagement level based on the pose data, the eye data, and the determination that the audience member was sleeping. . .”
Claim(s) 14, states that the “… (iii) determining the engagement level based on the pose data and the determination that the audience member was sleeping,..” However, the only write description are shown in Fig 1, 4, P. 49. (application 19023739), and Fig 1, P. 48 (application 13728515) “…For example, when the engagement level calculator 400 determines that the audience member 110 of FIG. 1 is sleeping, the engagement level for any media presentation device of the environment 100 is affected by the detection (e.g., is set to a level indicative of disengagement from the respective media presentation device).” only indicates using sleeping to determine disengagement, but nothing as claimed.
Further action is required.
