DETAILED ACTION Notice of Pre-AIA or AIA Status The present application is being examined under the pre-AIA first to invent provisions. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 56-66 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim 56 recites the limitation of “detect light reflected by the wound and surrounding normal tissue” which is not clear if that is the same light mentioned in “white light source configured to illuminate the wound and surrounding normal tissue during white light imaging” or from the earlier mentions of “light sources configured to emit excitation light” Similarly, the light in the limitation of “wound margin data based on the detected light reflected from the wound and surrounding normal tissue” is also not clear as to which light is being referred back to. Claim 56 further recites “biodistribution of bacteria in and around the wound is co-registered with one or more of the wound size data, wound shape data, wound depth data, and wound margin data in the white light image” which is also not clear how “biodistribution of bacteria in and around the wound is co-registered” with the parameters of “the wound size data, wound shape data, wound depth data, and wound margin data in the white light image”. In other words, it is not clear what meant by “co-register” and/or what is being done to “co-register” the parameters.
