Office Action

§112
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Election/Restrictions Claims 16-20 are withdrawn from further consideration pursuant to 37 CFR 1.142(b) as being drawn to a nonelected invention, there being no allowable generic or linking claim. Election was made without traverse in the reply filed on 24 July 2026. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claim 3 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. The phrase “each one of the cover layers comprises two of the cover sections coupled together one of a plurality of pressure-triggered couplings” is indefinite because it is unclear if each of the cover layers comprises cover sections and pressure-triggered couplings, or the cover sections comprise pressure-triggered couplings, or another variation. Appropriate clarification and correction is required. Allowable Subject Matter Claims 1-2, and 5-15 are allowed. The following is an examiner’s statement of reasons for allowance: Regarding Claim 1 and its dependents, the prior art of record does not clearly show or suggest the claimed system, especially including the pressure-triggered coupling configured to secure a constraining container in a closed configuration and configured to release the constraining container upon an interior pressure of the interior volume of the constraining container reaching a trigger pressure. Regarding Claim 15, The prior art of record does not clearly show or suggest the claimed system, especially including the pressure-triggered coupling configured to secure two of the container walls together and configured to release the two of the container walls upon an interior pressure of the interior volume reaching a trigger pressure, a pressure plug coupled to the one of the container walls and is movable relative to the one of the container walls such that a portion of the pressure plug is disposed in the interior volume to modify the interior volume, and a tensioner configured to selectively apply a tension between two of the container walls to control the interior pressure. Any comments considered necessary by applicant must be submitted no later than the payment of the issue fee and, to avoid processing delays, should preferably accompany the issue fee. Such submissions should be clearly labeled “Comments on Statement of Reasons for Allowance.” Claim 3 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action and to include all of the limitations of the base claim and any intervening claims. Claim 4 is objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Conclusion Any inquiry concerning this communication or earlier communications from the examiner should be directed to MONICA HUSON whose telephone number is (571)272-1198. The examiner can normally be reached M-F 8a-4p. Examiner interviews are available via telephone, in-person, and video conferencing using a USPTO supplied web-based collaboration tool.
