Examiner Notes
Examiner cites particular paragraphs, columns and line numbers in the references as applied to the claims below for the convenience of the applicant. Although the specified citations are representative of the teachings in the art and are applied to the specific limitations within the individual claim, other passages and figures may apply as well. It is respectfully requested that, in preparing responses, the applicant fully consider the references in entirety as potentially teaching all or part of the claimed invention, as well as the context of the passage as taught by the prior art or disclosed by the examiner.
Double Patenting
The non-statutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the "right to exclude" granted by a patent and to prevent possible harassment by multiple assignees. A non-statutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir. 1985); In re Van Ornum, 686 F.2d 937, 214 USPQ 761 (CCPA 1982); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); In re Thorington, 418 F.2d 528, 163 USPQ 644 (CCPA 1969).[AltContent: rect]
A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on non-statutory double patenting provided the reference application or patent either is shown to be commonly owned with the examined application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. See MPEP § 717.02 for applications subject to examination under the first inventor to file provisions of the AIA as explained in MPEP § 2159. See MPEP § 2146 et seq. for applications not subject to examination under the first inventor to file provisions of the AIA . A terminal disclaimer must be signed in compliance with 37 CFR 1.321(b). [AltContent: rect]
The filing of a terminal disclaimer by itself is not a complete reply to a non-statutory double patenting (NSDP) rejection. A complete reply requires that the terminal disclaimer be accompanied by a reply requesting reconsideration of the prior Office action. Even where the NSDP rejection is provisional the reply must be complete. See MPEP § 804, subsection I.B.1. For a reply to a non-final Office action, see 37 CFR 1.111(a). For a reply to final Office action, see 37 CFR 1.113(c). A request for reconsideration while not provided for in 37 CFR 1.113(c) may be filed after final for consideration. See MPEP §§ 706.07(e) and 714.13. [AltContent: rect]
The USPTO Internet website contains terminal disclaimer forms which may be used. Please visit www.uspto.gov/ patent/patents-forms. The actual filing date of the application in which the form is filed determines what form (e.g., PTO/SB/25, PTO/SB/26, PTO/AIA /25, or PTO/AIA /26) should be used. A web-based eTerminal Disclaimer may be filled out completely online using web-screens. An eTerminal Disclaimer that meets all requirements is auto-processed and approved immediately upon submission. For more information about eTerminal Disclaimers, refer to www.uspto.gov/ patents/apply/applying-online/eterminal-disclaimer.
Claims 1 – 16 rejected on the ground of non-statutory obviousness-type double patenting as being unpatentable over claims 1 - 17 of U.S. Patent No. 12271465 (Reference Patent) in view of Wang (US 20180041479). Although the claims at issue are not identical, they are not patentably distinct from each other because claims 1 – 17 of the Reference Patent anticipate the instant claims 1 – 16 as shown below for the first claim set where most of the limitations in claim 1 of instant application are anticipated by limitations in claims 1 and 16 of the reference patent.

Claim #
1
A method comprising:
at a first electronic device in communication with a display device and one or more input devices:
receiving, at the first electronic device, an indication that a second electronic device is in need of authentication credentials for a service;
in response to receiving the indication that the second electronic device is in need of authentication credentials for the service,
in accordance with a determination that the first electronic device meets respective criteria,
wherein the respective criteria include a requirement that the first electronic device is within a predetermined proximity to the second electronic device in order for the respective criteria to be met, displaying, via the display device,
a verification prompt that requires input of verification information on the first electronic device in order to proceed;
while displaying the verification prompt, receiving, via the one or more input devices, the verification information on the first electronic device; and in response to receiving the verification information,
initiating a process for sharing authentication credentials for the service from the first electronic device to the second electronic device.
A method comprising:

The reference patent (12271465) discloses an efficient method for managing authentication credentials for user accounts. Comparison between instant application and reference patent indicates that both are based on the same SPECS using identical drawings with respective disclosure. Both, document sets, i.e., the instant application and the reference patent, have the same applicant/assignee and same inventor (M. G. Daum). Comparison of the claims indicates that both documents disclose: receiving request for device verification, checking credentials if predefined criteria are met, displaying the results and sending respective messages. The claim sets include only the following distinctive features: implementation of different criteria for authentication in both recited document sets, i.e., proof of matches the predetermined formats of the messages, i.e., verification information sets of the first and second devices (reference patent); and the requirement that the first electronic device is within a predetermined proximity to the second electronic device (instant application). However, prior art of Wang addresses the recited limitations. Accordingly, obviousness rejections in this office action are based on the application of Wang as indicated below, see MPEP § 804, § 2136, § 2137, § 2138, and § 2154.
It would have been obvious to one having ordinary skill in the art before the effective filing date of the claimed invention to modify the claim set in reference patent, in view of the teaching of Wang which discloses linking authentication to specified proximity positions, i.e. locations or addresses, in order to improve digital content management and security of authentication in the system.
The independent claim 1 is rejected under the judicially created doctrine of double patenting as being directed to the same invention as that set forth in claim 1 of the United States Patent No. 12271465 in view of Wang. Independent claims 15 and 16 each encompass same or similar scope as claim 1 and rejected based on the same reasons set forth above in rejecting claim 1.
The dependent claims of the current application recite language similar to the dependent claims of the reference patent and are covered by the reference patent in view of Wang. Accordingly, the instant application is identified as obviousness-type double patenting.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented,
described in a printed publication, or in public use, on sale or otherwise available to the public
before the effective filing date of the claimed invention.
