Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 3, 4, 5, 6 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 3 recites “a same bottom plate” which is not clear as to what constitutes same.
Claim 4 recites “one to one correspondence” which is not clear as to what order or layout is claimed.
102 Rejections
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1-6 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by U.S. Patent No. Application No. US 2019/0010692 to Segall.
Regarding claim 1, Segal discloses a fully assembled storage room, comprising a plurality of wall panels (fig. 11: 180), a plurality of top plates (102b) and a plurality of bottom plates (174, 102c), wherein upper ends of the plurality of wall panels are detachably connected with the plurality of top plates, bottom ends of the plurality of wall panels is detachably connected with the plurality of bottom plates, and connecting assemblies (166) are respectively provided between the plurality of wall panels and the plurality of bottom plates and between the plurality of wall panels and the plurality of top plates.
Regarding claim 2, each of the connecting assemblies comprises a plurality of frameworks (150, 162, 167, 168), adjacent wall panels are detachably connected with each other, and each of the plurality of frameworks is detachably connected with adjacent wall panels.
Regarding claim 3, wherein a same bottom plate is connected between adjacent wall panels, and the bottom plate is detachably connected with the framework.
Regarding claim 4, wherein a top frame (150, 167) is detachably provided at an upper end of the framework, top frames are in one to one correspondence to the frameworks, adjacent top plates are detachably connected with each other, and the top frame is detachably connected with adjacent top plates.
Regarding claim 5, wherein a top beam (164) is connected between a plurality of top frames, the top beam is perpendicular to the plurality of top frames, and the top beam is connected with the top plate.
Regarding claim 6, wherein both ends of the top beam (164) are connected with a support frame, and a side top connected with the top plate is mounted on the support frame.
103 Rejections
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
Claim(s) 7 and 8 is/are rejected under 35 U.S.C. 103 as being unpatentable over U.S. Patent No. Application No. US 2019/0010692 to Segall
Regarding claim 7, wherein a gate is provided on the wall panel. However, a connecting frame between gate (fig. 6: 108) and wall is not explicitly disclosed. The Examiner takes official notice that it is well known in the art of construction to use door frames with doors as they are a necessary component to secure the door to a wall. It would have been obvious to one having ordinary skill in the art before the effective filing date of the claimed invention to modify Segall by using a door frame in order to better secure the door.
Regarding claim 8, wherein the gate is provided with a lock lever (handle shown on 108) but not a lock. The Examiner takes official notice that it is well known in the art of doors to use a lock on a handle. It would have been obvious to one having ordinary skill in the art before the effective filing date of the claimed invention to modify Segall by adding a lock to the handle for door security.
