Office Action

§102
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . DETAILED ACTION Claim 1 is pending in this application. Claim 1 is independent. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale or otherwise available to the public before the effective filing date of the claimed invention. (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. Claim 1 is rejected under 35 U.S.C. 102(a)(1) as being anticipated by Carlhian; Alexandre (US-20140365123-A1, hereinafter simply referred to as Alexandre). Regarding independent claim 1, Alexandre teaches: A method (e.g., FIG. 5 of Alexandre) implemented by a computing device (e.g., smartphone of Alexandre), the method comprising: receiving, from a location subsystem (e.g., device GPS of Alexandre), location information at a geographic location for the computing device (See at least Alexandre, ¶ [0038]; FIGS. 2, 5, 6–8); determining, by the computing device, that the geographic location of the computing device is associated with a significant location (e.g., point of interest (e.g., maneuver) of Alexandre) in a set of significant locations (e.g., points of interest (e.g., maneuvers) of Alexandre) accessible on the computing device (See at least Alexandre, ¶ [0035–0036, 0038, 0182]; FIGS. 2, 5, 6–8), wherein the significant location is a location having position coordinates inferred from clusters of position coordinates previously gathered by the computing device in response to a determination that the computing device dwelled at the location for a threshold amount of time (e.g., device position is updated dynamically – thus, indicating an inherent element of time dependency as taught in Alexandre) (See at least Alexandre, ¶ [0035–0038, 0042]; FIGS. 2, 5, 6–8); determining, by the computing device, a label (e.g., label of Alexandre) for the significant location based on analysis of contextual data for the significant location (See at least Alexandre, ¶ [0194, 0202–0203]; FIGS. 2, 5, 6–8), the contextual data comprising a movement pattern (e.g., movement of Alexandre) for a computing device (See at least Alexandre, ¶ [0194, 0202–0203]; FIGS. 2, 5, 6–8); and displaying, on a graphical interface of the computing device, the label for the significant location (See at least Alexandre, ¶ [0194, 0202–0203]; FIGS. 2, 5, 6–8). Conclusion The prior art made of record and not relied upon is considered pertinent to Applicant's disclosure: See the Notice of References Cited (PTO–892) Any inquiry concerning this communication or earlier communications from the examiner should be directed to IDOWU O OSIFADE whose telephone number is (571)272-0864.
