Claims 1-7, 10-17, 19-20 are rejected under 35 U.S.C. 103 as being unpatentable over GONG (CN 111752448) in view of LIANG et al (20220276680) and SHEN (20230082360).
As per claim 1, Gong teaches the claimed “information interaction method,” comprising: “in a process of a videocall, in response to a first interaction instruction, performing split-screen display on a display screen to form at least a first split screen and a second split screen, wherein the first split screen is configured to display an interface of the video call, and the second split screen is configured to display a shopping interface; in response to a first selection instruction, acquiring an image of a commodity corresponding to the first selection instruction” (Gong, page 2, Contents of the Invention - a receiving module, for displaying the instant communication interface in the first display area, receiving the first input of the user; an obtaining module, for responding to the first input, obtaining the input information corresponding to the first input, the input information comprises at least one of audio information and image information; a searching module for searching the target information associated with the input information; and a display module for displaying the target information on the second display area; Gong, figure 1, step S140, page 6, 2ⁿᵈ paragraph - Exemplary embodiments of the present invention relates to the electronic device may be a folding screen comprising a first screen and a second screen, and also can be a large screen display device comprising a first display area and a second display area); “wherein the first selection instruction is an instruction of selecting the commodity from the shopping interface” (Gong, figure 1, step S120 - exemplary, when the instant communication is a video call, the user when the video communication to the other display a beautiful cup, if desired to quickly the related information of the cup (such as purchase price, purchase source, material) sharing to each other; receiving the first input of the second preset control by the user, wherein the first input can be the touch input of the position of the user on the video picture, then in response to the first input, obtaining the image information of the user selected by the video picture, then automatically searching the related information of the cup according to the image information comprising the cup).
It is noted that Gong does not explicitly teach "displaying a synthesized image, wherein the synthesized image is an image obtained by performing image synthesis on the image of the commodity and at least a part of images in the interface of the video call." However, given Gong's display and edit the target information on the display areas (Gong, page 7, 4th and 5ᵗʰ paragraphs - receiving the editing operation of the first target information by the user, obtaining the edited first target information; updating and displaying the edited first target information. After the first target information is sent to the instant communication object, the user may want to mark or remark editing operation on the first target information, so as to achieve better communication effect with the instant communication object, at this time, it can receive the user editing operation of the first target information, obtaining and updating the first target information after displaying and editing. Namely before receiving the editing operation of the first target information by the user, displaying the first target information on the second display area, after receiving the editing operation of the first target information by the user, displaying the first target information after editing on the second display area), it would have been obvious to combine the target information and the displayed image on the second display area to form a synthesized image as claimed (see also Liang, [0114] - As shown in FIG. 1B, the application package may include applications such as Camera, Gallery, Calendar, Phone, Map, Navigation, WLAN, Bluetooth, Music, Videos, and Messages; [0136] - In this embodiment of this application, before a user receives a video call, the display 194 of the electronic device is displaying a first interface. Specifically, the first interface may include a home screen, a leftmost screen, and an interface of a first application. The first application may be any one of a plurality of applications included in the electronic device. For example, the first application may be an instant messaging application such as QQ or WeChat, or may be a social platform application such as Weibo, Twitter, or Facebook, or may be a shopping application such as Taobao or Amazon, or may be a video playback application such as TikTok or YouTube, or the like. This is not limited in this embodiment of this application. It should be noted that the first interface is a user interface displayed on the electronic device except a lock screen; Shen, [0095]-[0096] - For example, associated with the shopping scenario label, an application that is highly frequently used by the user may be: a shopping application, a product recommendation application, a payment application, and so on. For example, associated with the gaming scenario label, an application that is highly frequently used by the user may be: a live chat application, a messaging application, a video recording application, and so on). Thus, it would have been obvious, in view of Liang and Shen, to configure Gong's method as claimed by performing an image synthesis operation to generate a combined image of the image of the commodity and at least a part of images in the interface of the video call. The motivation is to provide an online effect of the selected commodity on the users in communication (e.g., Liang, Abstract - When a bending operation entered of the user is received on the electronic device, the electronic device displays the call interface on a first screen of a display, and displays, on a second screen of the display, an application interface displayed by the electronic device before answering a video call, the displaying on the first screen and the second screen allows, during the video call, the user to open the application interface displayed by the electronic device before answering the video call).
Claim 2 adds into claim 1 “wherein the interface of the video call comprises: a local video window configured to display images collected by a local terminal and a remote video window configured to display images collected by a remote terminal” (Liang, [0166] - The second image 263 may be an image of the second user initiating the video request. Optionally, the second image 263 may be displayed in full screen. The first image 261 may be a first image of the first user using the electronic device. The first image 261 is displayed over the second image 263 in a floating (superimposed) manner); and “before displaying the synthesized image, the method further comprises: acquiring at least one human image from images displayed in the local video window as a target human image; and synthesizing the image of the commodity and the target human image to obtain the synthesized image; or sending the target human image to a server, and receiving the synthesized image sent by the server” (Liang, [0172] - Optionally, the video call interface displayed on the first screen may be a display result obtained after adjusting an interface scale of the video call interface (namely, the user interface 24) displayed in full screen by the electronic device in the unfolded state. The first interface displayed on the second screen may be a display result obtained after adjusting an interface scale of the first interface (namely, the user interface 22) displayed in full screen by the electronic device in the unfolded state. Optionally, the video call interface displayed on the first screen may be different from the video call interface displayed in full screen. For example, to better display the second image 263 of the second user, the first image 261 may not be displayed on the first screen; [0174] - In this manner, the video call interface and the first interface displayed by the electronic device before answering the video call can be conveniently displayed in split screen). Thus, it would have been obvious, in view of Liang and Shen, to configure Gong's method as claimed by arranging displaying for the interface of the video call. The motivation is to provide an online effect of the selected commodity on the users in communication.
Claim 3 adds into claim 2 “wherein the first selection instruction is an instruction generated according to a click operation applied onto the shopping interface, or an instruction generated according to a first sliding operation applied onto the shopping interface; the click operation comprises: an operation of clicking the shopping interface through touch, or an operation of clicking the shopping interface through an air gesture; and the first sliding operation comprises: an air gesture operation of moving from the shopping interface to the interface of the video call, or a touch operation of moving from the shopping interface to the interface of the video call” which are obvious in a user interactive gestures for selection (e.g., touch, click, air gesture, …) (Gong, page 5, 3rd paragraph - Specifically, under the condition that the instant communication is a video call, the user displays the target object to the other party when the video communication, if it wants to quickly share the related information of the target object to the other party, the user can perform touch input on the target object position on the video image. and then responding to the touch input, obtaining the image information selected by the user in the video picture; Shen, [0041] - The terminal has a function of detecting an input operation performed by the user on a current display interface. In response to an activation operation performed by the user on the multi-task interface being detected, the terminal loads the multi-task interface on the current display interface. The terminal may display all applications, which may be running in the foreground and/or in the background, as thumbnail windows on the multi-task display interface. The user may select at least two applications, from a current display interface of the multi-task interface, as split applications and may input the split-screen sliding operation. As shown in FIG. 2, FIG. 2 is a schematic view of a multi-task interface. The current display of the multi-task interface in FIG. 2 displays a thumbnail window of an Application A, a thumbnail window of an Application B and a thumbnail window of an Application C. The user may select two adjacent Applications, the application A and the Application B, as split applications that will be displayed simultaneously on the split screen. Further, the user may slide in a direction indicated by a “black arrow” in FIG. 2 to complete the split-screen sliding operation on the Application A and the Application B. In the above process, the split-screen sliding operation may be performed by the user using a finger to touch a touch screen of the terminal. When the user uses the finger to touch the touch screen of the terminal, a capacitance parameter of a position touched by the finger is changed. A touch frame determines a position of the finger on the touch screen of the terminal based on the change of the capacitance parameter. In the process of the split-screen sliding operation, the terminal monitors the change in the capacitive parameter of the touch screen to obtain, for example, a sliding track of the finger. When the sliding track covers the thumbnail window of the application A and the thumbnail window of the application B, the terminal may take the application A and the application B as the split applications, which are involved in the present split-screen sliding operation. It shall be understood that the split-screen sliding operation of the user may be input for the application A, the application B and an application C along the direction indicated by the black arrow). Thus, it would have been obvious, in view of Liang and Shen, to configure Gong's method as claimed by interactive selecting (by click, touch, slide, air gesture, …) the split-screen windows.
Claim 4 adds into claim 3 “wherein the acquiring at least one human image from images displayed in the local video window as a target human image comprises: in response to that the first selection instruction is an instruction generated according to the click operation, detecting the number of human images in the local video window, and taking the human image as the target human image in response to that one human image exists in the local video window; in response to that the number of human images in the local video window is greater than 1, outputting an object selection request to remind a user to input object selection information; and in response to that the object selection information input by the user is received, determining the target human image according to the object selection information; and in response to that the first selection instruction is an instruction generated according to the first sliding operation, determining the target human image according to a path of the first sliding operation on the display screen” which is obvious in a online call application to multiple target humans (Shen, [0048] - In practice, the plurality of applications may be displayed on the multi-task interface, such as 6 or 9 applications displayed in 6 or 9 blocks. The user may slide or drag one or more applications, which will be displayed simultaneously on the split screen, by the third operation. The user may slide or drag the applications to display the applications, which will be displayed simultaneously on the split screen, at adjacent positions, such that the user may enter the fourth operation, such as the split-screen pinching operation, on each application easily; Liang, [0158] - Generally, the electronic device may receive, by using the keyboard/handwriting panel, text information entered by the user. The emoticon input control 246C is used to receive an operation of the user, and in response to the operation of the user, the electronic device displays a plurality of emoticon patterns/motion images for the user to select). Thus, it would have been obvious, in view of Liang and Shen, to configure Gong's method as claimed by interactive selecting (by click, touch, slide, air gesture, …) the split-screen window of human images.
Claim 5 adds into claim 2 “detecting the number of human images in the local video window, and in response to that a plurality of human images exist in the local video window, dividing the local video window into a plurality of local video sub-windows, each local video sub-window displaying one of the human images” which is obvious in an online call application to multiple target humans associated with multiple local windows (Shen, [0048] - In practice, the plurality of applications may be displayed on the multi-task interface, such as 6 or 9 applications displayed in 6 or 9 blocks. Thus, it would have been obvious, in view of Liang and Shen, to configure Gong's method as claimed by interactive selecting (by click, touch, slide, air gesture, …) the images for displaying on the split-screen windows.
Claim 6 adds into claim 2 “in response to the first selection instruction, acquiring link information of the commodity corresponding to the first selection instruction; and displaying the link information of the commodity in the local video window, and sending the link information to the remote terminal or the server” (Liang, [0114] - As shown in FIG. It should be noted that the first interface is a user interface displayed on the electronic device except a lock screen; Shen, [0095]-[0096] - For example, associated with the shopping scenario label, an application that is highly frequently used by the user may be: a shopping application, a product recommendation application, a payment application, and so on). Thus, it would have been obvious, in view of Liang and Shen, to configure Gong's method as claimed by acquiring and displaying link information of the commodity. The motivation is to provide an online effect of the selected commodity on the users in communication
Claim 7 adds into claim 2 “in response to a commodity recommendation instruction, acquiring information of a commodity corresponding to the commodity recommendation instruction; according to the information of the commodity corresponding to the commodity recommendation instruction, sending a reminding message to the remote terminal for a user of the remote terminal to select whether to accept a commodity recommendation; and in response to an acceptance instruction of the user of the remote terminal, synthesizing an image of the commodity corresponding to the commodity recommendation instruction and at least one human image in the remote video window” which is obvious in a commercial shopping online which provides the communication between the user and the selling sites related to the selling merchandises (Liang, [0136] - For example, the first application may be an instant messaging application such as QQ or WeChat, or may be a social platform application such as Weibo, Twitter, or Facebook, or may be a shopping application such as Taobao or Amazon, or may be a video playback application such as TikTok or YouTube, or the like. This is not limited in this embodiment of this application). Thus, it would have been obvious, in view of Liang and Shen, to configure Gong's method as claimed by recommending, acquiring and displaying information of the commodity. The motivation is to provide an online effect of the selected commodity on the users in communication.
Claim 10 adds into claim 1 “in response to a second interaction instruction, acquiring a pre-stored three-dimensional human model diagram of a local user from a local terminal, or performing image acquisition to acquire the three-dimensional human model diagram of the local user” (Liang, [0166] - The second image 263 may be an image of the second user initiating the video request. Optionally, the second image 263 may be displayed in full screen. The first image 261 may be a first image of the first user using the electronic device. The first image 261 is displayed over the second image 263 in a floating (superimposed) manner); in response to a second selection instruction, acquiring a three-dimensional model diagram of a commodity corresponding to the second selection instruction; synthesizing the three-dimensional human model diagram and the three-dimensional model diagram of the commodity to generate a first synthesized model diagram; and displaying the first synthesized model diagram in the local video window, and sending the first synthesized model diagram to a remote terminal or a server” (Gong, page 5 - For example: The target text information identified according to the target audio information " last week I went to see the film of the flower of the movie, and it was very good. "Identification is a" flower and wood "," movie ", according to the target key word" flower and wood "," movie " is matched in the resource information of each application program, and the target information is found… exemplary, when the instant communication is a video call, the user when the video communication to the other display a beautiful cup, if desired to quickly the related information of the cup (such as purchase price, purchase source, material) sharing to each other; receiving the first input of the second preset control by the user, wherein the first input can be the touch input of the position of the user on the video picture. then in response to the first input, obtaining the image information of the user selected by the video picture, then automatically searching the related information of the cup according to the image information comprising the cup). Thus, it would have been obvious, in view of Liang and Shen, to configure Gong's method as claimed by recommending, acquiring and displaying information of the three-dimensional human model diagram of the local user. The motivation is to provide an online effect of the selected commodity on the users in communication.
Claim 11 adds into claim 1 “in response to a window creation instruction, creating a sharing window in the interface of the video call; and in response to an information sharing instruction, displaying to-be-shared information corresponding to the information sharing instruction in the sharing window, the information displayed in the sharing window being configured to be shared between a local terminal and a remote terminal” (Gong, page 1, last paragraph - At present, the user in the voice call or video call through the instant communication, wants to share the related information involved in the voice call or video call process, generally needs to exit the current communication interface, manually searching the desired sharing related information, and then returning to the communication interface. and sending the related information to the other side; page 5, 3rd paragraph - Specifically, under the condition that the instant communication is a video call, the user displays the target object to the other party when the video communication, if it wants to quickly share the related information of the target object to the other party, the user can perform touch input on the target object position on the video image. and then responding to the touch input, obtaining the image information selected by the user in the video picture). Thus, it would have been obvious, in view of Liang and Shen, to configure Gong's method as claimed by sharing window in the interface of the video call. The motivation is to provide an online effect of the selected commodity on the users in communication.
Claim 12 adds into claim 11 “wherein the information sharing instruction is an instruction generated by performing a first preset operation on a file in the local terminal or the remote terminal; and the to-be-shared information comprises a file corresponding to the first preset operation” (Gong, page 1, last paragraph - At present, the user in the voice call or video call through the instant communication, wants to share the related information involved in the voice call or video call process, generally needs to exit the current communication interface, manually searching the desired sharing related information, and then returning to the communication interface. and sending the related information to the other side; page 5, 3rd paragraph - Specifically, under the condition that the instant communication is a video call, the user displays the target object to the other party when the video communication, if it wants to quickly share the related information of the target object to the other party, the user can perform touch input on the target object position on the video image. and then responding to the touch input, obtaining the image information selected by the user in the video picture). Thus, it would have been obvious, in view of Liang and Shen, to configure Gong's method as claimed by performing a first preset operation on a file in the local terminal or the remote terminal. The motivation is to provide an online effect of the selected commodity on the users in communication.
Claim 13 adds into claim 11 “wherein the information sharing instruction comprises: a first sharing instruction and a second sharing instruction, the first sharing instruction is an instruction generated by performing a second preset operation on a preset human model diagram in the local terminal or the remote terminal” (Liang, [0166] - The second image 263 may be an image of the second user initiating the video request. Optionally, the second image 263 may be displayed in full screen. The first image 261 may be a first image of the first user using the electronic device), and “the second sharing instruction is an instruction generated by performing a third preset operation on the shopping interface” (Gong, page 1, last paragraph - At present, the user in the voice call or video call through the instant communication, wants to share the related information involved in the voice call or video call process, generally needs to exit the current communication interface, manually searching the desired sharing related information, and then returning to the communication interface. and sending the related information to the other side; page 5, 3rd paragraph - Specifically, under the condition that the instant communication is a video call, the user displays the target object to the other party when the video communication, if it wants to quickly share the related information of the target object to the other party, the user can perform touch input on the target object position on the video image. and then responding to the touch input, obtaining the image information selected by the user in the video picture); and the, in response to an information sharing instruction, displaying to-be-shared information corresponding to the information sharing instruction in the sharing window comprises: in response to the first sharing instruction, displaying a preset human model diagram corresponding to the first sharing instruction in the sharing window; and in response to the second sharing instruction, synthesizing a three-dimensional model diagram of a commodity corresponding to the second sharing instruction and a preset human model diagram in the sharing window to generate a second synthesized model diagram, and sending the second synthesized model diagram to the sharing window” (Gong, page 2, Contents of the Invention - a receiving module, for displaying the instant communication interface in the first display area, receiving the first input of the user; an obtaining module, for responding to the first input, obtaining the input information corresponding to the first input, the input information comprises at least one of audio information and image information; a searching module for searching the target information associated with the input information; and a display module for displaying the target information on the second display area; Gong, figure 1, step S140, page 6, 2ⁿᵈ paragraph - Exemplary embodiments of the present invention relates to the electronic device may be a folding screen comprising a first screen and a second screen, and also can be a large screen display device comprising a first display area and a second display area). Thus, it would have been obvious, in view of Liang and Shen, to configure Gong's method as claimed by sharing window in the interface of the video call. The motivation is to provide an online effect of the selected commodity on the users in communication.
Claims 19 and 20 claim a non-transitory computer-readable storage medium and a communication terminal based on the method of claims 1-13; therefore, they are rejected under a similar rationale.
As per claim 14, Gong teaches the claimed “information interaction method,” comprising: “in the process of a video call, in response to a third interaction instruction, performing split-screen display on a display screen to form at least a third split screen and a fourth split screen” (Gong, page 2, Contents of the Invention - a receiving module, for displaying the instant communication interface in the first display area, receiving the first input of the user; an obtaining module, for responding to the first input, obtaining the input information corresponding to the first input, the input information comprises at least one of audio information and image information; a searching module for searching the target information associated with the input information; and a display module for displaying the target information on the second display area; Gong, figure 1, step S140, page 6, 2ⁿᵈ paragraph - Exemplary embodiments of the present invention relates to the electronic device may be a folding screen comprising a first screen and a second screen, and also can be a large screen display device comprising a first display area and a second display area); “wherein the third split screen is configured to display a local video window, and the fourth split screen is configured to display a remote video window; in response to an acquisition instruction, acquiring an image of a target object from images displayed in the remote video window” (Gong, figure 1, step S120 - exemplary, when the instant communication is a video call, the user when the video communication to the other display a beautiful cup, if desired to quickly the related information of the cup (such as purchase price, purchase source, material) sharing to each other; receiving the first input of the second preset control by the user, wherein the first input can be the touch input of the position of the user on the video picture, then in response to the first input, obtaining the image information of the user selected by the video picture, then automatically searching the related information of the cup according to the image information comprising the cup). It is noted that Gong does not explicitly teach " synthesizing the image of the target object and an image in the local video window, and performing video transmission with a remote terminal based on the synthesized image." However, given Gong's display and edit the target information on the display areas (Gong, page 7, 4th and 5ᵗʰ paragraphs - receiving the editing operation of the first target information by the user, obtaining the edited first target information; updating and displaying the edited first target information. For example, associated with the gaming scenario label, an application that is highly frequently used by the user may be: a live chat application, a messaging application, a video recording application, and so on; Hsieh, Abstract - In this paper, we aim to resolve the above challenges by proposing a novel FashionOn network to synthesize user images fitting different clothes in arbitrary poses to provide comprehensive information about how suitable the clothes are. Specifically, given a user image, an in-shop clothing image, and a target pose (can be arbitrarily manipulated by joint points), FashionOn learns to synthesize the try-on images by three important stages: pose-guided parsing translation, segmentation region coloring, and salient region refinement). Thus, it would have been obvious, in view of Liang, Shen and Hsieh, to configure Gong's method as claimed by performing an image synthesis operation to generate a combined image of the image of the commodity and at least a part of images in the interface of the video call. The motivation is to provide an online effect of the selected commodity on the user (e.g., Liang, Abstract - When a bending operation entered of the user is received on the electronic device, the electronic device displays the call interface on a first screen of a display, and displays, on a second screen of the display, an application interface displayed by the electronic device before answering a video call, the displaying on the first screen and the second screen allows, during the video call, the user to open the application interface displayed by the electronic device before answering the video call). Thus, it would have been obvious, in view of Liang and Shen, to configure Gong's method as claimed by arranging displaying for the interface of the video call. The motivation is to provide an online effect of the selected commodity on the users in communication.
Claim 15 adds into claim 14 “wherein the acquisition instruction is an instruction generated according to a second sliding operation on the display screen; and the synthesizing the image of the target object and an image in the local video window comprises: according to a moving path of the second sliding operation, determining a target placement position of the image of the target object in the image in the local video window; and according to the target placement position, synthesizing the image of the target object and the image in the local video window” which is obvious in a online call application to multiple target humans (Shen, [0048] - In practice, the plurality of applications may be displayed on the multi-task interface, such as 6 or 9 applications displayed in 6 or 9 blocks. Thus, it would have been obvious, in view of Liang and Shen, to configure Gong's method as claimed by arranging displaying for the interface of the video call. The motivation is to provide an online effect of the selected commodity on the users in communication.
Claim 16 adds into claim 15 “wherein the, according to the target placement position, synthesizing the image of the target object and the image in the local video window comprises: in response to that a definition adjustment instruction is received, performing definition enhancement processing on the image of the target object to obtain a first image, and performing definition reduction processing on the image in the local video window to obtain a second image; and covering the first image on a target placement position of the second image according to the target placement position” (Shen, [0051] - It shall be understood that when the user wants to select and adjust a certain application, the user may move an application thumbnail window of the certain application to a predetermined location, such as a middle line, of the multi-task interface. When the user wants to select and adjust a plurality of applications, the plurality of applications may be selected by multiple fingers; [0055] - That is, the terminal may display the selected applications at random regions, and subsequently provide a control for the user to adjust the regions for displaying the selected applications. The user may perform the adjustment by triggering the control). Thus, it would have been obvious, in view of Liang and Shen, to configure Gong's method as claimed by performing adjustment of the display of the interface of the video call. The motivation is to provide an online effect of the selected commodity on the users in communication.
Claim 17 adds into claim 14 “wherein the performing video transmission with a remote terminal based on the synthesized image comprises: displaying the synthesized image in the third split screen, performing image processing on the synthesized image, and sending the processed image to the remote terminal or a server” (Gong, page 6, 4th paragraph - the user can set the preset display priority displayed by the target information according to the source information and the attribute information of the target information according to the actual requirement; the source information of the target information comprises but not limited to the local; the network and the cloud server).
Claims 8-9 and 18 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
The following is a statement of reasons for the indication of allowable subject matter:
In claim 8 and its dependent claim 9, the allowable feature is “in response to a comparison instruction, acquiring at least two synthesized images generated in a history record of the video call, and displaying the at least two synthesized images for comparison; wherein the at least two synthesized images comprise at least two first synthesized images, or at least two second synthesized images, or at least one first synthesized image and at least one second synthesized image; and the first synthesized image is a synthesized image of a human image in the local video window and the image of the commodity, and the second synthesized image is a synthesized image of a human image in the remote video window and the image of the commodity.”
In claim 17, the allowable feature is “after determining the target placement position of the image of the target object in the image in the local video window, the method further comprises: performing image recognition on the image in the local video window, and acquiring a size of an accommodating space at the target placement position, wherein the accommodating space is a space for placing the target object; and determining whether the target object matches the accommodating space according to a size of the target object and the size of the accommodating space and in response to that the target object does not match the accommodating space, generating a recommendation message or a reminding message.”
