DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . This is in response to the priority documents filed 3/17/2025. Priority Receipt is acknowledged of certified copies of papers required by 37 CFR 1.55. Information Disclosure Statement The information disclosure statement filed 1/23/2025 has been considered. Claim Objections 4. Claim 8 is objected to because of the following informalities: The word Calculate is capitalized and could be corrected as calculate. Appropriate correction is required. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. Claim(s) 1-17 is/are rejected under 35 U.S.C. 102(a)(1) and/or 102(a)(2) as being anticipated by Zheng et al., US PGPub 2011/0282798 A1. Regarding claim 1, Zheng et al., shows an apparatus comprising: processing circuitry configured to (Fig. 1): acquire location information of a plurality of users; extract, from the location information of the plurality of users, a user who has visited a predetermined spot during a predetermined period (210; Fig.2); and generate, as activities-on-that-day data, data on where the user has been during preceding and subsequent periods per a predetermined unit time relative to a timing when the spot has been visited by the user who has visited the predetermined spot based on the location information of the extracted user (Figs. 1-4; [0014]-[0059]). Regarding claim 3, Zheng et al., shows the apparatus according to claim 2, wherein in generating the activities-on-that-day data, perform clustering in consideration of a chronological order based on location information of the spot visited by the user on that day ([0026]; e.g. Chronological order). d. Regarding claim 13, Zheng et al., shows the apparatus according to claim 9, wherein in comparing the activities-on-that-day data and the daily-activities data, perform clustering of dates when the user has acted based on importance on a spot (Fig. 2-4; [0030] and [0043]). n. Regarding claim 14, Zheng et al., shows the apparatus according to claim 9, wherein the processing circuitry further configured to: match with a similar cluster in an activity pattern of another user to an activity of the user daily or on that day based on the result of clustering for the user (Fig. 2-4; [0052]-[0059. o. Regarding claim 15, Zheng et al., shows the apparatus according to claim 14, wherein the processing circuitry further configured to:2 based on the matching, recommend to a matched user as to a spot or contents assumed to follow an activity pattern daily or on that day in a similar cluster (Fig. 4; [0052]-[0059]; e.g. steps 440-490). p. Regarding claim 16, Zheng et al., shows a method performed by a computer, wherein the computer comprises processing circuitry configured to: acquire location information of a plurality of users; extract, from the location information of the plurality of users, a user who has visited a predetermined spot during a predetermined period; and generate, as activities-on-that-day data, data on where the user has been during preceding and subsequent periods per a predetermined unit time relative to a timing when the spot has been visited by the user who has visited the predetermined spot based on the location information of the extracted user (Fig. 1-4; [0024]-[0059)). Liu et al., US PGPub 2011/0143775 A1, is cited as pertinent prior art for the instant application. Liu et al., is also teaches various considerations in data analysis with wireless/mobile computing between multiple users and locations.
