Priority 02-26 AIA Receipt is acknowledged of certified copies of papers required by 37 CFR 1.55. Claim Rejections - 35 USC § 102 07-06 AIA 15-10-15 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. 07-07-aia AIA 07-07 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – 07-08-aia AIA (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. 07-12-aia AIA (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. 07-15-aia AIA Claim(s) 1-8 is/are rejected under 35 U.S.C. 102 (a)(1) and 35 U.S.C. 102(a)(2) as being anticipated by Jung et al (U.S. Patent Application Publication 2012/0086141 A1) . Regarding claim 1, Jung et al (see the entire document, in particular, paragraphs [0002], [0013], [0014], [0017], [0043], [0046], [0047] and [0050]; Figures 1, 4, 7, 8 and 10) teaches a process (see paragraph [0002] (method for manufacturing multi-component plastic molded parts) of Jung et al), including (a) a first mold which has a first surface (see Figures 1 and 4, paragraph [0043] (fixed platen 2) of Jung et al); (b) a second mold which has a second surface (see Figures 1 and 4, paragraph [0043] (movable platen 4) of Jung et al); (c) an intermediate mold . . . rotating between the first mold and the second mold (see Figures 1 and 4, paragraphs [0043] (middle platen 6) and [0047] (middle platen 6 is rotatable) of Jung et al); (d) a first molding step . . . face the first surface (see Figure 5, paragraph [0046] (half-molds A1 and A2 form a first cavity for producing a preform of component A) of Jung et al); (e) a second molding step . . . face the first surface (see Figure 5, paragraphs [0046] (half-molds B1 and B2 form a second cavity for producing a preform of component B) of Jung et al); (f) a third molding step . . . face the second surface (see Figure 8, paragraph [0047] (component A remains attached to half-mold A1; half-molds A1 and A3 form a new cavity for injecting plastic material) of Jung et al); and (g) a fourth molding step . . . face the second surface (see Figure 8, paragraph [0047] (component B remains attached to half-mold B1; half molds B1 and B3 form a new cavity for injecting plastic material) of Jung et al). Regarding claim 2, see paragraph [0013] (additional, different cavities and additional components may be added in further cycles) of Jung et al. Regarding claims 3 and 4, see Figures 7 and 10 (rotation of middle platen 6 provides the desired positioning of the surfaces) of Jung et al. Regarding claims 5-7, see Figure 4, paragraphs [0017] (inserts and/or decorations may be inserted and affixed for the subsequent processes), [0050] (place inserts or decorations into the half-molds) and [0046] (pretreatments may be performed in free half-molds A3 and B3 by robots 16, 17) of Jung et al. Regarding claim 8, see paragraph [0013] (additional (e.g., different) thermoplastic components can be molded) of Jung et al . 07-15-aia AIA Claim(s) 9 and 10 is/are rejected under 35 U.S.C. 102 (a)(1) and 35 U.S.C. 102(a)(2) as being anticipated by Jung et al (U.S. Patent Application Publication 2012/0086141 A1) .
