Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claim(s) 1 is/are rejected under 35 U.S.C. 102(a)(1)(a)(2) as being anticipated by Wu et al. (US 20170335547).
1. Wu et al. teach:
An electric apparatus (fig 2) comprising:
an electric power storage device/battery 19;
a rotary electric machine/motor generator 12 having a plurality of coils (the coils are inherently disclosed since the motor generator is an alternating current one…para 0081 whole para);
an electric power control unit 30 that is connected to the electric power storage device (para 0196) and the rotary electric machine (fig 2) and controls electric power transfer of each of the electric power storage device (for motor control, see para 0224; for battery control, see para 0196) and the rotary electric machine;
a first temperature acquisition portion (for temperature sensor included in battery, see para 0196) that acquires a temperature of the electric power storage device; and
a second temperature acquisition portion 12A that acquires a temperature of the rotary electric machine,
wherein by controlling electric power supply of the plurality of coils in accordance with each temperature acquired by the first temperature acquisition portion and the second temperature acquisition portion (the controller shuts the motor down when the motor is overheated, see para 0224 whole para), the electric power control unit switches between and performs a first mode in which a heat generation amount of the electric power storage device is larger than a heat generation amount of the rotary electric machine (this is being interpreted as an over-heated battery and the controller shuts the motor down, see para 0196 whole para) and a second mode in which a heat generation amount of the electric power storage device is smaller than the heat generation amount of the electric power storage device in the first mode (this is being interpreted as a state when the motor is overheated and in which case, the controller shuts the motor down, see para 0224).
Allowable Subject Matter
Claims 2-4 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Kubota et al. (US 20230098598) – general state of the art.
