Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claims 1-2 and 5 are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Naotsugu Onuma “Onuma” (JPS59100743A).
Regarding claim 1, Onuma discloses a method of processing a yarn spindle (Par. 0001, lines: 1-4), comprising: after determining a target yarn box to be transferred to a temporary storage facility, selecting N candidate storage locations from a plurality of storage locations in the temporary storage facility (Page 3, lines: 33-46, examiner notes line 33 starts with “Example 1 A 75 denier 66 filament polyester false twisted yarn”, and the storage locations are indoors and a dark box), wherein the target yarn box contains a plurality of yarn spindles to be cooled, and N is a positive integer greater than or equal to 1 (Page 2, lines: 37-40, Examiner notes line 37 starts with “This is a method for storing a polyester false-twisted yarn package,” and that N is equal to 1); obtaining an actual temperature of each of the N candidate storage locations; and selecting a target storage location from the N candidate storage locations based on the actual temperature of each candidate storage location (Page 3, lines 28-35 and 40, examiner notes the location was selected based on temperature), and temporarily storing the target yarn box to the target storage location (Page 3, lines: 37-42, examiner notes the target storage location is dark box, 2).
Regarding claim 2, Onuma discloses after determining the target yarn box to be transferred to the temporary storage facility, selecting the N candidate storage locations from the plurality of storage locations in the temporary storage facility, comprises: after determining the target yarn box to be transferred to the temporary storage facility, determining M storage locations in an idle state from the plurality of storage locations in the temporary storage facility (Page 3, lines: 33-46, examiner notes the M storage locations are the indoor location and the dark box); and in a case of the quantity M of the storage locations is less than or equal to the first threshold value (Examiner notes the “first threshold value” is equal to 2, due to M being equal to 2 locations), designating the M storage locations in the idle state as the N candidate storage locations (examiner notes the N storage location, from claim 1, is 1, which is part of the locations to choose from for M storage locations) .
Regarding claim 5, Onuma discloses wherein selecting the target storage location from the N candidate storage locations based on the actual temperature of each candidate storage location, and temporarily storing the target yarn box to the target storage location comprises: obtaining a target temperature of the target yarn box; and after determining that at least one candidate storage location having a temperature difference with respect to the target temperature of the target yarn box within the preset temperature difference range exists in the N candidate storage locations, determining a target storage location from the at least one candidate storage location having the temperature difference with respect to the target temperature of the target yarn box within the preset temperature difference range, and temporarily storing the target yarn box to the target storage location (Page 3, lines 28-33 and line: 40, examiner notes the temperature range is lower than 25ᴼC and higher than 5ᴼC, and for the example presented the temperature picked or “target temperature” for the box, 2, was 19ᴼC).
Conclusion
The prior art made of record and not relied upon is considered pertinent (See
PTO-892) to applicant's disclosure.
