Office Action

§DP
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Application Status Present office action is in response to application filed 01/28/2025. Claims 1-18 are currently pending in the application. Double Patenting The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory obviousness-type double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir. 1985); In re Van Ornum, 686 F.2d 937, 214 USPQ 761 (CCPA 1982); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); and In re Thorington, 418 F.2d 528, 163 USPQ 644 (CCPA 1969). A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on a nonstatutory double patenting ground provided the conflicting application or patent either is shown to be commonly owned with this application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. Effective January 1, 1994, a registered attorney or agent of record may sign a terminal disclaimer. A terminal disclaimer signed by the assignee must fully comply with 37 CFR 3.73(b). Claims 1-18 are rejected on the ground of nonstatutory obviousness-type double patenting as being obvious over claims 1-18 of US Patent No. 11,922,595 in view of Mancuso et al. (US 20200311424 A1) (Mancuso). US Patent No. 11,922,595 US Application No. 19/039,610 Claim 1. Claim 13. A non-transitory computer readable memory comprises: a first memory element that stores operational instructions that, when executed by a processing module, causes the processing module to: generate a virtual reality environment utilizing a group of object representations in accordance with interaction information for at least some of the object representations of the group of object representations, wherein at least some of the object representations are associated with corresponding three-dimensional (3-D) physical objects, wherein the interaction information includes 3-D models and position information for the at least some of the object representations of the group of object representations, wherein a first set of object representations of the group of object representations is associated with a first piece of information regarding a topic, wherein a second set of object representations of the group of object representations is associated with a second piece of information regarding the topic, wherein the processing module generates the virtual reality environment by: identifying a set of common illustrative assets based on the first and second set of object representations, wherein the set of common illustrative assets belongs to the first and second sets of object representations and depict one or more aspects regarding the topic pertaining to the first and second pieces of information; identifying an exclusion asset of the set of common illustrative assets, wherein utilization of the exclusion asset is to be excluded when an unauthorized receiving entity does not have sufficient authorization to access the exclusion asset; and processing the set of common illustrative assets to exclude the exclusion asset to produce a redacted set of common illustrative assets; a second memory element that stores operational instructions that, when executed by the processing module, causes the processing module to further generate the virtual reality environment by: rendering a portion of the redacted set of common illustrative assets to produce a redacted set of common illustrative asset video frames; selecting a subset of the redacted set of common illustrative asset video frames to produce a common redacted portion of video frames for the virtual reality environment with regards to the first and second sets of object representations to reduce duplicative rendering; rendering another representation of the first set of object representations to produce a first remaining portion of the video frames for the virtual reality environment with regards to the first set of object representations; and rendering another representation of the second set of object representations to produce a second remaining portion of the video frames for the virtual reality environment with regards to the second set of object representations; and a third memory element that stores operational instructions that, when executed by the processing module, causes the processing module to further generate the virtual reality environment by: linking the common redacted portion, the first remaining portion, and the second remaining portion of the video frames to produce the virtual reality environment for interactive consumption by the unauthorized receiving entity. US Patent No. 11,922,595 appears to be silent on but Mancuso teaches or at least suggests wherein utilization of the exclusion asset is to be excluded when an unauthorized receiving entity does not have sufficient authorization to access the exclusion asset (at least ¶ 38: determine whether a user associated with the first device is authorized to receive the shared content associated with the identified user of the second device … accessing and checking permissions of the first user and/or defined sharing policies of the second user and/or the shared content … determining that the user of the first device is authorized to receive the shared content, augmentation system 100 may provide the shared content associated with the identified user for display …; ¶ 71: … determine, in any suitable way, whether a user associated with device 204-1 is authorized to receive shared content provided by the user identified in captured imagery. If the user associated with device 204-1 is unauthorized to receive the shared content, augmentation server 202 may prevent the shared content from being provided to and displayed by device 204-1. However, if the user associated with device 204-1 is authorized to receive the shared content, augmentation server 202 may provide the shared content to device 204-1 for presentation together with imagery captured and displayed by device 204-1 in a graphical user interface view of a user interface of device 204-1). Hence, it would have been prima facie obvious to one of ordinary skill in the art, before the effective filing date of the invention, to have utilized the content permission features of Mancuso to modify US Patent No. 11,922,595 as claimed because this would amount to no more than applying known techniques to a known method (device, or product)) ready for improvement to yield predictable results. See KSR Int’l Co. v. Teleflex Inc., 550 U.S. 398, 416 (2007) (“The combination of familiar elements according to known methods is likely to be obvious when it does no more than yield predictable results.”). Claims 2-6, 8-12 and 14-18 are rejected as being dependent upon rejected base claims 1, 7 and 13. Additionally, any subject matter differences in the dependent claims would have been obvious variations in view of known knowledge and at least the prior art of record including prior art cited in the Information Disclosure Statement (IDS) filed by Applicant on 01/28/2025. Claims 1-18 are rejected on the ground of nonstatutory obviousness-type double patenting as being obvious over claims 1-18 of US Patent No. 12,217,381. The claims are not patentably distinct from each other as shown by representative independent claims below: US Patent No. 12,217,381 US Application No. 19/039,610 Claim 1. As shown above, the claims are not patentably distinct from each other because the limitations set forth in claims 1, 7 and 13 of the instant application are comparable in scope to corresponding claims 1, 7 and 13 of US Patent No. 12,217,381. Any claimed subject matter differences would have been obvious variations in view of knowledge and at least the prior art of record including prior art cited in the Information Disclosure Statement (IDS) filed by Applicant on 01/28/2025. Allowable Subject Matter Claims 1-18 would be allowed if the Double Patenting rejections were overcome with properly filed terminal disclaimers. Conclusion The prior art made of record and not relied upon is listed in the attached PTO Form 892 and is considered pertinent to applicant's disclosure.
