Information Disclosure Statement
The information disclosure statement filed 02/02/2025 fails to comply with the provisions of 37 CFR 1.98(a)(4) because it lacks the appropriate size fee assertion. It has been placed in the application file, but the information referred to therein has not been considered as to the merits.
The information disclosure statement filed 02/02/2025 fails to comply with the provisions of 37 CFR 1.97(a) because it lacks the appropriate size fee set forth in 37 CFR 1.17(v). It has been placed in the application file, but the information referred to therein has not been considered as to the merits.
Specification
The lengthy specification has not been checked to the extent necessary to determine the presence of all possible minor errors. Applicant’s cooperation is requested in correcting any errors of which applicant may become aware in the specification.
Drawings
The drawings are objected to as failing to comply with 37 CFR 1.84(p)(5) because they do not include the following reference sign(s) mentioned in the description1: 2021, 2212 and 2213. Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance.
Claim Objections
Claim 10 is objected to because of the following informalities: Claim 10, line 3, what does it mean by “consistent” as recited in the claim? For examination purpose, the examiner understood the term to mean “similar”. Appropriate correction is required.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claim 10 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
The limitation “the preceding elementary antenna” and “the array”, recited in claim 10, line 3, each lacks of proper antecedent basis, as claim 1 does not include any limitations to an “array” including a “preceding elementary antenna”.
Allowable Subject Matter
Claim 10 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action.
Claims 1-9 are allowed.
The following is a statement of reasons for the indication of allowable subject matter: an elementary antenna is disclosed. The closest prior art, JP2020505892 discloses a similar antenna system (fig. 1 ) as including a radiating element (10) including a plurality of zone and a plurality of input ports; a transmit/receive module (1) comprising amplifier (118) and a phase shifter (29). However, it fails to teach, in combination with the other claimed limitations, “an i-th compensation phase shifter, located on a second side of said i-th amplifier opposite the first side, and wherein the sum of the phases brought in by said i-th robustness phase shifter and the i-th compensation phase shifter is constant whichever chain is considered, and the phase brought in said i-th robustness phase shifter is strictly different from the phase brought in by the other robustness phase shifters of the other chains of the elementary antenna”. Such limitations, as recited in the claim are neither anticipated nor rendered obvious by JP reference.
