Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 5-7, 18-20, and 30-32 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
With respect to claims 5 and 30, the phrase “wherein p is between 0.01 to 0.99 and q is between 0.01 and 0.99” includes situations wherein the atomic percentage is over 100%, up to 198%, which does not appear to be possible.
With respect to claim 18, the phrase “wherein the Lutetium is about 1 at% to about 99 at% and the Yttrium is about 1 at% to about 99 at%” includes situations wherein the atomic percentage is over 100%, up to 198%, which does not appear to be possible.
Claims 6, 7, 19, 20, 31, and 32 are rejected for reasons of dependency.
Allowable Subject Matter
Claims 1-4, 8-17, 21-29, and 33-37 are allowed.
Claims 5-7, 18-20, and 30-32 would be allowable for reasons of dependency if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action.
The following is a statement of reasons for the indication of allowable subject matter:
Wang et al. (US 2021/0054272 A1) discloses a scintillator crystal (“a crystal”, abstract) comprising a structure of cerium, calcium, and magnesium (par. [0052], “X may consist of at least one of Ce…”, and “M may consist of at least one of Ca, Mg…”) doped lutetium yttrium orthosilicate (LYSO) (formulae shown in par. [0052]).
With respect to claims 1 and 26, the cited prior art does not specify the relative x, y, and z values, nor does the cited prior art describe the R value of the crystalline structure having the claimed value.
With respect to claim 13, the cited prior art does not specify the relative values of cerium, calcium, and magnesium.
Claims 2-4, 8-12, 14-17, 21-25, 27-29, and 33-37 are allowable for reasons of dependency.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
