Double Patenting
The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim because the examined application claim is either anticipated by, or would have been obvious over, the reference claim.
Claim 1 is rejected on the ground of nonstatutory double patenting as being unpatentable over claims 1-16 of U.S. Patent No. 12,314,715. Although the claims at issue are not identical, they are not patentably distinct from each other because the claimed invention simply claims a broader scope from the ‘715 patent.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claim 1 is rejected under 35 U.S.C. 102(a)(1)/(a)(2) as being anticipated by Kothari (US 2021/0,072,997).
Referring to claim 1, Kothari discloses an integrated circuit (fig. 1, processor 12) comprising:
a load store unit (fig. 1, LSU 20/MDR22) to receive (fig. 1, decode to MDR22/LSU20) store micro-operations (para.0030, ops; para.0050, media ops) cracked from a vector store operation (para.0030, program; para.0050, vector operations), and unroll (para.0026, reorder out-of-order ops) each store micro-operation (para.0026, op) into multiple sub-micro-operations (para.0026, out-of-order ops), the load store unit including:
an issue status vector (fig. 1, MDR 22; para.0026) to track issuance of each sub-micro-operation to a store data pipeline (fig. 7, load pipeline 120) to write data;
an unroll status vector (fig. 1, reorder buffer 26; para.0026, track program order of ops) to track unrolling of each sub-micro-operation (para.0026, op) associated with a group of sub-micro-operations (para.0026, out-of-order ops); and
a replay status vector (fig. 6, replay load 104; fig. 1, LDQ 54; paras.0031-0032, track executions) to track replayability of sub-micro-operations associated with the group of sub-micro-operations.
