The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Election/Restrictions
Applicant’s election without traverse of Group I, claims 1-10 in the reply filed on 07/07/2026 is acknowledged.
Drawings
The drawings are objected to under 37 CFR 1.83(a). The drawings must show every feature of the invention specified in the claims. Therefore, the removable clips supporting a surface of the string trimmer must be shown or the feature(s) canceled from the claim(s). No new matter should be entered.
Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance.
Double Patenting
The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir. 1985); In re Van Ornum, 686 F.2d 937, 214 USPQ 761 (CCPA 1982); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); In re Thorington, 418 F.2d 528, 163 USPQ 644 (CCPA 1969).
A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on nonstatutory double patenting provided the reference application or patent either is shown to be commonly owned with the examined application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. See MPEP § 717.02 for applications subject to examination under the first inventor to file provisions of the AIA as explained in MPEP § 2159. See MPEP § 2146 et seq. for applications not subject to examination under the first inventor to file provisions of the AIA . A terminal disclaimer must be signed in compliance with 37 CFR 1.321(b).
The filing of a terminal disclaimer by itself is not a complete reply to a nonstatutory double patenting (NSDP) rejection. A complete reply requires that the terminal disclaimer be accompanied by a reply requesting reconsideration of the prior Office action. Even where the NSDP rejection is provisional the reply must be complete. See MPEP § 804, subsection I.B.1. For a reply to a non-final Office action, see 37 CFR 1.111(a). For a reply to final Office action, see 37 CFR 1.113(c). A request for reconsideration while not provided for in 37 CFR 1.113(c) may be filed after final for consideration. See MPEP §§ 706.07(e) and 714.13.

Claim 1 is rejected on the ground of nonstatutory double patenting as being unpatentable over claims 1-2 of U.S. Patent No. 12,082,525. Although the claims at issue are not identical, they are not patentably distinct from each other because claims 1-2 of U.S. Patent No. 12,082,525 teaches a removable shield comprising a flexible shield wall and a shield closure device having a vertical panel (the parallel channels in claim 2) and a horizontal lip (the floor of claim 2).
Claim Rejections - 35 USC § 112
The following is a quotation of the first paragraph of 35 U.S.C. 112(a):
(a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention.
The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112:
The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention.
Claim 10 is rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention.
Regarding claim 10, it is unclear what kind of surface of the string trimmer the clips support.
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claims 7-9 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Blevins (6,327,782).
Regarding claim 7, teaches a shield closure for a shield attachment for a string trimmer comprising:
a vertical wall panel 26 having one or more elongated slots in a surface thereof;
a channel (section receiving element 24) positioned at a bottom of the vertical wall panel, wherein a length of the channel is at least the same as or is greater than a width of the vertical wall panel; and
a cradle (39, 44) positioned on top of the vertical wall panel wherein the cradle has a cavity along a length thereof and a textured surface for increasing a coefficient of friction along the length of the cavity.

Regarding claim 8, a flexible shield wall 24 is best seen in Fig. 1.
Regarding claim 9, the flexible shield wall received in the channel is best seen in Fig. 1.
Claim Rejections - 35 USC § 103
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
Claims 1-6 are rejected under 35 U.S.C. 103 as being unpatentable over Blevins (6,327,782) in view of Macedonio et al. (2016/0262306), hereinafter Macedonia.
Regarding claim 1, Blevins teaches an assembly for a string trimmer with trimmer head for cutting tall grass or weed substantially as claimed except for the limitations in the bolded texts, the assembly comprising:
a removable shield having a flexible shield wall 24 having a first end and a second end with a length extending therebetween;
a shield closure device 26 comprising a vertical panel and a horizontal lip for supporting and closing the first end and second of the removable shield; and
wherein the shield forms a perimeter ring providing an interior space when coupled to the shield closure, and when installed on the string trimmer, the trimmer head is within the interior space.
See Figs. 1, 4, and 5.
Blevins does not teach the shield closure device “closing the first end and second of the removable shield; and wherein the shield forms a perimeter ring providing an interior space when coupled to the shield closure, and when installed on the string trimmer, the trimmer head is within the interior space”. In other words, the shield fully surrounds the trimmer head.
Macedonio teaches an assembly for a string trimmer having a removable shield 16fully covering a trimmer head. See Fig. 3.
Therefore, it would have been obvious to one skilled in the art before the effective filling date of the claimed invention to make the shield and the shield closure device on Blevins fully surrounding the trimmer head as taught by Macedonio for trimming process that requires fully enclosing the trimmer head.
Regarding claim 2, the shield closuring device in Fig. 5 comprises multiple channels.
Regarding claim 3, a handle cradle (39, 44) is best seen in Figs. 1 and 7 in Blevins.
Regarding claim 4, a cradle top (top section of element 44) is best seen in Fig. 7 in Blevins.
Regarding claim 5, a channel (in section 35) extending along the shield closure is best seen in Fig. 5 in Blevins.
Regarding claim 6, a clip (in section 35) is best seen in Fig. 5 in Blevins.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Shields for a string trimmer of general interest are cited in form PTO-892.
