Office Action

§112
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Priority This application, filed 02/05/2025 Claims Priority from Provisional Application 63550933, filed 02/07/2024. Status of Claims Claims 1, 18, 29-30, 55-56, 68, 75, 78, 82, 93, 99, 102, 107, 116-117, and 121-124 are currently pending. Claims 2-17, 19-28, 31-54, 57-67, 69-74, 76-77, 79-81, 83-92, 94-98, 100-101, 103-106, 108-115, 118-120, and 125-132 have been canceled. Claims 1, 18, 29-30, 55-56, 68, 75, 78, 82, 93, 99, 102, 107, 116-117, and 121-124 were examined. Claims 116 and 117 are rejected. Claims 1, 18, 29-30, 55-56, 68, 75, 78, 82, 93, 99, 102, 107, and 121-124 are allowed. Claim Rejections-35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 116-117 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claims 116 and 117 recite under the groups of R1a “wherein each…. 4- to 10-membered heterocyclyl… of R1a”, however the claims don’t include 4- to 10-membered heterocyclyl as an option of functional groups for R1a. There is insufficient antecedent basis for this limitation in the claims, and the claims are indefinite. Allowable Subject Matter The following is a statement of reasons for the indication of allowable subject matter: the compounds of formula (I) of independent claim 1, and the compounds of claim 121 are not taught or suggested by the prior art. Tian et. al., WO 2023072284 A1, publ. 5/4/2023 (English language equivalent US 20250000864 A1) represents the closest prior art. Tian teaches compounds of the structural formula shown below as gonadotropin-releasing hormone antagonists: PNG media_image1.png 200 400 media_image1.png Greyscale PNG media_image2.png 200 400 media_image2.png Greyscale . While the compounds taught by Tian are structurally similar to the compounds of formula (I), particularly as X1=O, they differ from the instantly claimed compounds by the -CH2-NR1R2 substituent on the ring, which is not included as an option for Rx1 or Rx2. Information Disclosure Statements The IDS filed on 5/12/25, 6/17/25, 3/18/26, and 9/11/26 have been considered.
