Office Action

§112
DETAILED ACTION 1. This is in reply to an application filed on 05/13/2025. Claims 2-21 are pending examination. 2. The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . 3. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (B) CONCLUSION.-The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. 1. Claims 1-14 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor, or for pre-AIA the applicant regards as the invention. Claims 1, 13 and 14: It is unclear how the reported vulnerability is going to affect the countermeasure taken by the security countermeasure software for the identified threat type. Examiner interpreted the claims to the best of his knowledge. Note none of the dependent claims address this issue. Claim 3: It is unclear to which “a change” the phrase “when the change represents no change or a decrease in risk” refers to, for example claim 1 recites “a change in the second risk value”, and claim 3 recites “when a change in a risk value represented by the risk value change information”. Applicant should address these issues. Examiner interpreted the claims to the best of his knowledge. Claims 13 and 14: It is unclear how the risk value change information representing a change in the second risk value with respect to the first risk value. Applicant should address this issue (see claim 3). Examiner interpreted the claims to the best of his knowledge. Conclusion Any inquiry concerning this communication or earlier communications from the examiner should be directed to AYOUB ALATA whose telephone number is (313)446-6541. The examiner can normally be reached on Monday - Friday 7:30 - 5:00 Est.
