Claim Rejections - 35 USC § 112 07-30-02 AIA The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. 07-34-01 Claims 1-13 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. The following recitation, for example, in indep claim 1 is awkwardly written: please correct globally: A superconducting quantum circuit apparatus comprising: a qubit; and a first wiring with a wiring used as a transmission of a signal to generate a magnetic flux to be applied to the qubit and a wiring used as a transmission of a signal input by capacitive coupling to and/or output , by capacitive coupling from the qubit, combined together thereinto, as a single wiring. What exactly is meant by the “… by capacitive coupling to and/or output…” The dependent claims 2-13 all depend from claim 1, ultimately, and thus indefitinite too. Claims 3 and 11 should both depend from claim 2 to avoid antecedent basis issues: such as, 07-34-05 AIA Claim 3 recites the limitation " the first SQUID " in line 3 of claim . There is insufficient antecedent basis for this limitation in the claim. 07-34-05 AIA Claim 11 recites the limitation " a second Inductor " in in line 3 of claim . There is insufficient antecedent basis for this limitation in the claim. 07-34-05 AIA Claim 11 recites the limitation " a second SQUID " in line 5 of claim . There is insufficient antecedent basis for this limitation in the claim. Claim Rejections - 35 USC § 102 07-06 AIA 15-10-15 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. 07-07-aia AIA 07-07 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – 07-12-aia AIA (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. 07-15-03-aia AIA Claim(s) 1 (as best understood) is/are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Abraham et al (US 9,344,092) The figure below(see labeling) to Abraham et al shows a superconducting quantum circuit apparatus with a TRANSMON qubit ; and a first wiring(WIRING)(as labeled by examiner) with the wiring used as a transmission of a high frequency signal to generate a magnetic flux via the INDUCTOR(40 and source)to be applied to the qubit and the wiring used as a transmission of a signal input by capacitive coupling( C c) to and/or output , by capacitive coupling from the qubit, combined together thereinto, as a single wiring .
