Office Action

§112
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . DETAILED ACTION This office action is in response to Applicant’s submission filed on 2/19/2025 (with Apparent priority date of 3/01/2024). Claims 1-30 are pending of which claims 1, and 16 are independent. As such, claims 1-30 have been examined. Specification The disclosure is objected to because of the following informalities: In the Abstract, the term “phrase extraction layer” was used, However, in the specification, the term “phase extraction layer” was also used as well as “phase correction”. There appears to be some inconsistencies between the Abstract, drawings and the specification that should be thoroughly check for unless both phrases are meant to be used, as those two terms does not appear to be interchangeable. Likewise in the specification, the terms “phrase” and “phase” are used throughout, it is not entirely clear which term the Applicant intended to use or if both, but both terms are also used to reference to reference designator 260 which is also reference to as “phase corrector” of fig. 2. Appropriate correction is required. Drawings The drawings are objected to because in figure 7, in box 714, the term “phrase extraction layer” is used, but in the specification of the instant application, para 0004 and 0063, the term “phase extraction layer” is also used. Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-30 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. In in independent claims 1 and 16, “a phrase extraction layer” is recited, however, in the specification, “a phase extraction layer” is also referenced. It is not clear which term or both term is intended by the Applicant or if the Applicant is using the two terms interchangeably. There does not appear to be custom or Applicant defined terms that explicitly define either of the terms mentioned, therefore its not clear which term is the intended term, or if they can be used interchangeably. However, in standard dictionary, the term “phase” and “phrase” are not the same, or considered synonyms of one to another. Potentially Allowable Subject Matter Claims 1-30 would be potentially allowable if amended to overcome the pertinent rejections under section of the 112 rejections. The following is a statement of reasons for the indication of potentially allowable subject matter: With respect to Claim 1, The closest prior arts found during the search are as follows: Caroselli (US 20230298612) discloses: 1. Accordingly, although the combination of prior art appears to disclose majority of the elements by individually teach bits and pieces of limitations of the claim, the prior art of record fails to explicitly teach or fairly suggest the invention in a reasonable combination as set forth in claim 1. Other independent claims 16, although different in statutory category, but contain similar limitations as claim 1, therefore also contains potentially allowable subject matter. Further dependent claims 2-15, and 17-30 inherit the potentially allowable subject matter from claims 1, and 16 respectively, and thus, also contain potentially allowable subject matter by virtue of their dependency. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure: Narayanan US 20230038982 discloses method for ASR using joint acoustic echo cancellation, speech enhancement and voice separation.
