Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1 – 6 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 1 recites the limitation "the substrate" in lines 15 and 16 and in lines 18 and 19. There is insufficient antecedent basis for this limitation in the claim. It is unclear whether the applicant is referring back to the limitation an insulating dummy substrate at line 5 or an insulating substrate at line 7.
Claims 2 - 6 are rejected by virtue of their dependency on claim 1.
Allowable Subject Matter
Claims 1 - 6 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action.
Prior Art of Record
The prior art made of record and not relied upon is considered pertinent to applicant s disclosure.
Akushichi et al. (12,066,506) is cited for its disclosure of a magnetic sensor including a sensor chip mounted on a surface of a substrate such that an element formation surface is perpendicular to the surface of the substrate or inclined by a predetermined angle with respect thereto; an external magnetic member mounted on the surface of the substrate and collecting a magnetic field to be detected in a magnetosensitive element; and a compensating coil wound around the external magnetic member.
Suzuki et al. (10,756,404) is cited for its disclosure of a magnetoresistance effect device and magnetoresistance effect module.
HASHIO et al. (2010/0259255) is cited for its disclosure of a structure has a magnetism shield member mounted externally on a housing. A lower cover of an upper surface faces surface of a bus bar and the magnetism shield member. A projecting portion is formed on the cover, which projects upward from the upper surface of the cover. A screw hole is formed in the lower surface of the housing fitting on the projecting portion, which passes through the hole in the bus bar, when the bus bar and the magnetism shield member are held by the upper surface of the cover and the lower house of the housing.
