Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1-6 and 8-11 are is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Rabeony et al. (WO2012/146761). Rabeony et al. discloses the use of a misuse preventing mechanism (Figs. 14-16 and 18-20) disposed on a rotatable child safety seat (2), the rotatable child safety seat having a base (1,149) and an installation bracket (100,150) coupled to the base and configured to support a carrier body, the installation bracket being capable of rotating with respect to the base and having a restraining groove (73,152,153), the misuse preventing mechanism comprising a lock member (82,159,160) disposed on the base and driven to extend into the restraining groove to restrain a rotation angle of the carrier body. The lock member including a first guiding hole (Fig. 16, 157) extending in a longitudinal direction parallel to a driving direction (1510) of the lock member. A driving assembly (70,71,74,7578,151,155,156,157,158,165) comprising an operating member (70,71,151) pivotally connected to a linkage member (74,75,156) through a guiding pillar (76,77,165). Regarding claim 2, the restraining groove has a first and second (161,162). Regarding claim 3, Rabeony et al. discloses that the carrier body can be retrained in angle between first and second ends of the restraining groove and that the angle would inherently be within 180 degrees and less than 270 degrees as the carrier body may disposed in a “road facing” (or forward) position and a “back road” (or rear facing position) which are 180 degrees from one another. Regarding claim 4, an end of the linkage member is (indirectly) pivotally connected to the operating member (via the entirety of the pivot support) and another end of the linkage member is pivotally connected to the lock member (Fig. 16). Regarding claims 5-6, Rabeony shows the linkage member (156) having a second guiding hole (158) in a middle portion thereof wherein the guiding pillar is inserted in the first and second guiding holes. The operating member is operated to cause the linkage to swing under guidance of the guiding pillar to drive the lock member to either extend into or eject from the restraining groove under guidance of the guiding pillar. Regarding claim 8, the operating member is disposed on an outer surface of the base and the linkage (partially) and lock member are disposed within the base (upon entering the restraining groove). Regarding claims 9-10, the base includes a third guiding hole (1550, 1560) and the linkage member (and base) is pivotally connected to the operating member (which is a knob) through the third guiding hole. Regarding claim 11, Rabeony shows the use of an extension hole (at the entrance of the restraining groove (73)) which allows the lock member to extend into or eject from the restraining groove.
Allowable Subject Matter
Claim 7 is objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
