Claim Rejections - 35 USC § 103
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
The factual inquiries for establishing a background for determining obviousness under 35 U.S.C. 103 are summarized as follows:
1. Determining the scope and contents of the prior art.
2. Ascertaining the differences between the prior art and the claims at issue.
3. Resolving the level of ordinary skill in the pertinent art.
4. Considering objective evidence present in the application indicating obviousness or nonobviousness.
Claim(s) 1-10 is/are rejected under 35 U.S.C. 103 as being unpatentable over Ochi WO_2022196767_A1 (see machine English translation).
Regarding Claims 1, 3, 4, 5, Ochi discloses a laminate (paragraph 0018) comprising a substrate made of concrete (element 12 in Fig.) (paragraph 0016), with a foamed polyurethane layer (element 14 in Fig.) (corresponds to claimed primer layer) over said substrate, followed by a non-foamed polyurethane foam layer (element 16 in Fig.) (corresponds to claimed reinforcing layer), and finally followed by a top layer (element 18 in Fig.) (Abstract) wherein said top layer can be made of fluorine (paragraph 0005), and in particular fluoroolefin (paragraph 0022) and examples of which correspond to Cf2=CFCl, as is being claimed in claims 1, 3, 4, and 5.
Regarding Claims 2, 7, Ochi discloses the weight % of fluorine can be 10 to 20 wt% (paragraph 0040).
Regarding Claim 6, Ochi discloses using non-fluorinated polymer (paragraph 0053).
Regarding Claim 8, Ochi discloses using acrylic resins (paragraph 0050).
Regarding Claim 9, Ochi discloses non-foamed PU layer whose thickness can range from 1 to 10,000 microns (paragraph 0017) while the top layer can have a thickness range from 1 to 1000 microns (paragraph 0018). Thus, it can meet the claimed range.
Regarding Claim 10, Ochi discloses all of the claimed limitations of the top layer, thus, it would be expected for it to inherently have the same physical properties such as transmittance.
