The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
The disclosure is objected to because of the following informalities: Page 3, line 23, note that the heading “DISCLOSURE” should be rewritten as --SUMMARY OF THE INVENTION-- for consistency with PTO guidelines. At all instances throughout the specification, note that the reference to “the PA board” is vague in meaning and thus appropriate clarification is needed. Page 14, line 24, note that the heading “Description of Drawings” should be rewritten as --Detail Description of the Drawings-- for consistency with PTO guidelines. Page 17, line 16, note that the heading “Best Mode” should be rewritten as --Best Mode for Carrying Out the Invention-- for consistency with PTO guidelines. Page 17, line 23, note that --throughout the detail description of the drawings-- should be inserted after “numeral” for an appropriate characterization. Appropriate correction is required.
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-21; 22; 23 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor, or for pre-AIA the applicant regards as the invention.
In claim 1, lines 4 & 5, note that the recitation of “a predetermined thickness or less” is vague in meaning. Appropriate clarification is needed.
In claim 2, lines 22, 24 and in claim 23, lines 19, 20, 22, note that the respective recitation of “through a medium of” is vague in meaning, at these instances. Appropriate clarification is needed.
In claim 4, lines 2, 3 and in claim 5, lines 8, note that the respective recitation of “resonator panel installation slits” is vague in meaning, at these instances. Appropriate clarification is needed.
In claim 5, lines 7, 10, note that it is unclear, even in light of the specification, as to what would characterize “insertion ends” (i.e. line 7) and “front ends” (i.e. line 10), respectively at these instances. Appropriate clarification is needed.
In claim 10, line 4 and in claim 14, line 2, note that the recitation of “is penetrated up and down” is vague in meaning, respectively at these instances. Appropriate clarification is needed.
In claim 15, line 4; in claim 19, line 2; in claim 21, lines 2, 6: note that it is unclear, even in light of the specification, as to what would characterizes a/the ‘PA board”, respectively at these instances. Appropriate clarification is needed.
In claim 15, lines 11 & 12, note that it is unclear how “a predetermined electrical signal”, as recited herein would relate to “a predetermined electrical signal” recited earlier in lines 8 & 9 of this claim (i.e. one in the same electrical signal, separate and distinct electrical signals, etc.) and thus appropriate clarification is needed; lines 13 & 14, note that it is unclear with respect to which one of the two previous recitations of “a predetermined electrical signal” would the recited “the predetermined electrical signal” be associated with and thus appropriate clarification is needed.
In claim 21, line 2, note that it is unclear, even in light of the specification, as to what would characterize “in an SMT way”. Appropriate clarification is needed.
In claim 22, line 27, note that the recitation of “through media of” is vague in meaning. Appropriate clarification is needed.
The following claims have been found to be objectionable for reasons set forth below:
In claim 10, line 3 and in claim 16, lines 4 & 5, note that the recitation of “an empty inside” should be rewritten as --a hollow interior--, respectively at these instances for an appropriate characterization.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale or otherwise available to the public before the effective filing date of the claimed invention.
Claims 1-3; 22; 23 are rejected under 35 U.S.C. 102(a)(1) as being clearly anticipated by West et al (cited by applicants’).
West et al (i.e. FIGS. 1A, 2-6) discloses a filter device, comprising: a base plate (i.e. blank 20) made of a conductive material (i.e. a conductive material sheet) initially configured in an unfolded state (i.e. as evident from FIG. 1), wherein as evident from FIGS. 2-6, the base plate is folded to form the filter, including forming a plurality of resonators (i.e. 60, 62, 64, 66) configured to protrude within a cavity when the base plate is completely folded. Regarding claims 2, 22, as a result of the folding of the base plate (20), the resultant filter includes a bottom panel (e.g. unlabeled, but is best seen in FIGS. 2 & 3), first side panel (e.g. housing end 178) and a second side panel (e.g. housing end 179), a resonator panel (e.g. partial housing wall (147) which is best seen in FIGS. 2 & 3), a frequency tuning panel including a plurality of tuning bars (i.e. capacitance tabs (160, 162, 164, 166) in FIG. 4) aligned with, but spaced apart from the plurality of resonators (60, 62, 64, 66) and an upper panel (i.e. unlabeled, but is seen in FIGS. 5, 6). Regarding claim 3, as evident from FIGS. 2, 3 & 6, the resonator panel (147) in FIGS. 2 & 3 is oriented orthogonal to the first and second side panels (178, 179) in FIG. 6. Regarding claim 23, as evident from FIGS. 2-6, a specific sequence of folding steps occurs that results in a fully folded filter, as best seen in FIG. 6.
