Claim Rejections - 35 USC § 112
Claims 13-24 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. In claim 13, line 2, the term “comprising” and on line 12, “comprises” are vague and indefinite, in that, multiple “comprising” terms are permissible, however, each element introduced after “comprising” must be clearly tied back to the earlier elements. In this case, the two “comprising” statements stand alone and are not connected with one another by the intended use statement of “for pushing the poultry from the at least one first carrier of the supply line”.
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. The prior art cited, 20160021902, 5453045, 12356998 and 41786659 are alternative nonobvious poultry transfer systems commonly used in the industry.
Any comments considered necessary by applicant must be submitted no later than the payment of the issue fee and, to avoid processing delays, should preferably accompany the issue fee. Such submissions should be clearly labeled “Comments on Statement of Reasons for Allowance.”
