This rejection under 35 U.S.C. 102(a)(2) might be overcome by: (1) a showing under 37 CFR 1.130(a) that the subject matter disclosed in the reference was obtained directly or indirectly from the inventor or a joint inventor of this application and is thus not prior art in accordance with 35 U.S.C. 102(b)(2)(A); (2) a showing under 37 CFR 1.130(b) of a prior public disclosure under 35 U.S.C. 102(b)(2)(B) if the same invention is not being claimed; or (3) a statement pursuant to 35 U.S.C. 102(b)(2)(C) establishing that, not later than the effective filing date of the claimed invention, the subject matter disclosed in the reference and the claimed invention were either owned by the same person or subject to an obligation of assignment to the same person or subject to a joint research agreement. Niikawa discloses an image forming apparatus [1] comprising an opening/closing member [10] rotatably supported by an image forming apparatus main body [Col. 4, lines 50-58] and configured to open and close with respect to the image forming apparatus main body by being rotated [Fig. 3]; a connecting member [32] having one end portion supported by the image forming apparatus main body [part on the left which is pivotably supported at rotation center A shown in Fig. 3], and the other end portion supported by the opening/closing member [part on the right which connected with the opening/closing member shown in Fig. 3]; a support member [22] configured to support the other end portion of the connecting member, a restricting member [31]; a switching member [83] configured to be switched between a support position [Fig. 3(a)] and a release position [Fig. 3(b)]; and a biasing spring [96].
