Office Action

§102
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim(s) 1 is rejected under 35 U.S.C. 102(a)(1) as being anticipated by CN 206368946 U to Peng, Shi-chang et al. (Peng). In Reference to Claim 1 Peng, see Fig.1-3 discloses: [AltContent: textbox (A)][AltContent: connector] PNG media_image1.png 645 510 media_image1.png Greyscale A speed regulating apparatus, comprising: a casing (transmission housing 9); a first speed regulating mechanism disposed in the casing, the first speed regulating mechanism comprising a main power input component (15), an auxiliary power input component (A), and a speed regulating gear (7), wherein: the main power input component (15) comprises a first input shaft being configured to receive a driving force, a plurality of first planetary gears (3), and a first output shaft 14 being configured to output the driving force; the speed regulating gear is rotatably connected to the casing (and is separately in transmission connection with the plurality of first planetary gears; and the auxiliary power input component comprises an auxiliary power input gear 2 rotatably connected to the casing 9, further in transmission connection with the speed regulating gear (7). Allowable Subject Matter Claim 2-10 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims, primarily because the prior art of record cannot anticipate Applicant’s claimed invention by a single reference nor render Applicant’s claimed invention obvious by the combination of more than one reference. The following is a statement of reasons for the indication of allowable subject matter: Furthermore, the prior art of record does not teach “wherein: the speed regulating gear (7) further comprises a first inner gear ring (231) and an outer gear ring (232), the first inner gear ring (23 1) and the outer gearing ring (232) being coaxially arranged; the speed regulating gear (23) is nested on an outer side of the plurality of first planetary gears (213) and is meshed with the plurality of first planetary gears (213) separately through the first inner gear ring (231); and the speed regulating gear (23) is meshed with the auxiliary power input gear (221) through the outer gear ring (232). ” as within the context of the claimed invention as disclosed and within the context of the other limitations present in claim 2; The prior art of record does not teach “the main power input component (21) further comprises a first sun gear (211) and a first planetary carrier (212), the first sun gear (211) and the first planetary carrier (212) being rotatably connected to the casing (10) separately; and the plurality of first planetary gears (213) are rotatably connected to the first planetary carrier (212) and are further in transmission connection with the first sun gear (211), a rotating shaft of the first sun gear (211) being the first input shaft, and a rotating shaft of the first planetary carrier (212) being the first output shaft.” as within the context of the claimed invention as disclosed and within the context of the other limitations present in claim 3; and The prior art of record does not teach “an output end of the speed regulating apparatus (01) is in transmission connection with an input end of the power end assembly (02), the output end of the power end assembly (02) being in transmission connection with an input end of the hydraulic end assembly (03); in a first working mode state, the main power input component (21) is started and the auxiliary power input component (22) is stopped, for the plunger pump to run at a first displacement level; in a second working mode state, the main power input component (21) is stopped and the auxiliary power input component (22) is started, for the plunger pump to be started at a second3 displacement level smaller than the first displacement level and to run at a variable speed; and in a third working mode state, both the main power input component (21) and the auxiliary power input component (22) are started, for the plunger pump to be started at a third displacement level greater than the first displacement level and to run at a variable speed. ” as within the context of the claimed invention as disclosed and within the context of the other limitations present in claim 10. Therefore, the prior art of record cannot anticipate Applicant’s claimed invention by a single reference nor render Applicant’s claimed invention obvious by the combination of more than one reference. Any comments considered necessary by applicant must be submitted no later than the payment of the issue fee and, to avoid processing delays, should preferably accompany the issue fee. Such submissions should be clearly labeled “Comments on Statement of Reasons for Allowance.” Conclusion Any inquiry concerning this communication or earlier communications from the examiner should be directed to ANTHONY AYALA DELGADO whose telephone number is (571)270-3452.
