Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1-4 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Yokota, US 20190242983.
Claim 1:
YOKOTA discloses a method of displaying a corrected image in a surveying device, using the surveying device (See YOKOTA Abstract) comprising:
an imaging unit having an imaging element configured to capture an image (See YOKOTA Paragraph 00071);
a scanning mirror (See YOKOTA Paragraphs 0006; 00182) configured to rotate about a rotation shaft in one of a horizontal direction or a vertical direction (See YOKOTA Paragraph 00183), and having a flat reflection surface inclined relative to the rotation shaft (See YOKOTA Paragraph 00184);
an angle measuring sensor configured to measure a rotation angle of the rotation shaft (See YOKOTA Paragraph 00185);
a controller (See YOKOTA Paragraph 00986);
and a support frame having therein the imaging unit that is fixed inside the support frame (See YOKOTA Paragraph 0076) and that does not rotate about the rotation shaft (See YOKOTA Paragraph 0018), the scanning mirror (See YOKOTA Paragraphs 0006; 0018), the angle measuring sensor (See YOKOTA Paragraph 0018), and the controller (See YOKOTA Paragraph 0098),
to display the image captured by the imaging unit on a display (See YOKOTA Paragraph 00077) of the surveying device or a display of a mobile terminal (See YOKOTA Paragraphs 0058-00598), the method comprising:
first imaging of capturing (See YOKOTA Paragraph 00079), by the imaging unit (See YOKOTA Paragraph 000710), a first image when the scanning mirror is in a first position (See YOKOTA Paragraphs 0006; 0018);
rotating, by the controller (See YOKOTA Paragraph 009811), the scanning mirror by a first angle from the first position to a second position in a rotational direction of the rotation shaft (See YOKOTA Paragraphs 0006-0007; 0018; 0098);
second imaging of capturing, by the imaging unit, a second image at the second position (See YOKOTA Paragraph 0007);
image correcting of generating, by the controller (See YOKOTA Paragraph 009812), a corrected image, in which rotation of the second image and displacement about the rotation shaft are corrected (See YOKOTA Paragraphs 0006-0007), based on rotation center coordinates (See YOKOTA Paragraphs 0006-0007), the first angle, and the second image (See YOKOTA Paragraph 000713);
and corrected image displaying of displaying (See YOKOTA Paragraphs 0006-0007), by the controller (See YOKOTA Paragraph 009814), the corrected image (See YOKOTA Paragraphs 0006-0007), instead of the second image, on the display of the surveying device or the display of the mobile terminal (See YOKOTA Paragraphs 0058-005915).
Claim 2:
Claim 2 is rejected on the same basis as claim 1.
Claims 2-4:
Claims 2-4 are rejected on the same basis as claim 1.
Pertinent Art
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
US 11592291 discloses detection of a target by a surveying device is automated to achieve simple work. A surveying method uses a surveying device for detecting and identifying a target device having an entire circumference reflection prism and a code display that is arranged in a vertical direction. The surveying device has a laser scanner configured to perform laser scanning along a vertical plane while horizontally rotating. The surveying method includes performing laser scanning by emitting laser scanning light along the vertical plane while making the surveying device horizontally rotate, and detecting the code display on the basis of the laser scanning light that is reflected back.
