Claim Rejections - 35 USC § 112 07-30-02 AIA The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. 07-34-01 Claims 3, 11, 21 and 22 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim 3 claims that “the threshold value is a minimum margin defined in an instruction manual of the foil printer”, where a threshold value referenced as being contained in an instruction manual is considered to be indefinite since the threshold value is not clearly defined. In claim 11, line 2, “The” could be changed to “the”. Claim 21 is considered to be indefinite since it is not a sentence, as such, it is unclear as to whether or not the claim is complete, where on line 11 of claim 21, “sheet,” could be changed to “sheet, and” and on line 14 of claim 21, “sheet,” could be changed to “sheet.”. In claim 22, line 3, “ae” could be changed to “a”. Allowable Subject Matter 12-151-07 AIA 07-97 12-51-07 Claim s 1, 2, 4-10, 12-20 and 23-26 are allowed. Prior Art 07-96 AIA The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Kishi et al. (US 2022/0082982), Ichikawa et al. (US 2022/0306416) and Sakai et al. (US 2023/0234118) disclose a unit for adhering foil onto a sheet.
