The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claims 1, 18 and 20 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Wu et al. (US 20170171135).
As to claim 1, Wu discloses a method of data processing, the method comprising:
obtaining a media file of haptic media (Figs. 1A-1B), the media file comprising a first portion and a second portion, wherein the first portion includes a bitstream of media data of the haptic media and the second portion includes relationship indication information indicating an association relationship between the haptic media (Figs. 1A(100): haptic effect inst) and at least a non-haptic media (Fig. 1A(100): public message, [0021] – [0022], [0030] – [0031], [0038]: message coordination module 148 can consult a user profile to determine user preferences related to which haptic message should be provided); and
decoding the bitstream according to the relationship indication information to obtain the media data for presenting the haptic media (Figs. 1A-1B, [0024] – [0025]: haptic output, [0031], [0038], [0039]: receives a different haptic message along with the common post message; “haptic message” can be interpreted as “haptic media” and “common post message” and “non-haptic media”, [0046]).
As to claim 18, it is the apparatus that performs the operation of claim 1. Please see claim 1 for detail analysis.
As to claim 20, it is the non-transitory computer-readable storage medium storing instructions for performing the functions of claim 1. Please see claim 1 for detail analysis.
Allowable Subject Matter
Claims 2-17 and 19 are objected to as being dependent upon a rejected base claims, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
