Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
DETAILED ACTION
This Office action is based on the 19/101209 application originally filed February 04, 2025.
Amended claims 1-36, filed February 04, 2025, are pending and have been fully considered.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 5-7, 12-14 and 33 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Regarding Claims 5-7 and 12-14 are unclear to the basis for the claimed ratios making the claims indefinite. The claimed ratios fail to define a metric system for the ratios (i.e. weight, volume, etc.). Further clarification and/or amending the claims are required.
Claim 33 is unclear to the phrase “halocarbons(chlorinated paraffins)” due to the parenthesis renders the claim indefinite. It is unclear whether the limitation(s) following within the parenthesis are part of the claimed invention. See MPEP § 2173.05(d).
Allowable Subject Matter
Claims 1-4, 8-11, 15-32 and 34-36 are allowed.
The present invention is allowable over the prior art references listed on PTO-892, applied prior art and Information Disclosure Statement fails to teach and/or suggest a lubricating fluid comprising: a Hydrogenated Linear AMS Dimer of 2,4-dicyclohexyl-2-methylpentane with a structure of:

, as presently claimed in independent claim 8 of the present invention.
The closest art to the presently claimed invention includes Wu et al. (US 2020/0291322) and Duling et al. (US 4,046,703). Wu discloses in paragraph 0018, the chemical structure of HAD (CAS 38970-72-8; 2,4-dicyclohexyl-2-methylpentane) is presented in Formula I, meeting the 2,4-dicyclohexyl-2-methylpentane of claims 1 and 8 of the presently claimed invention. Duling discloses in column 2 lines 44-50, traction fluid comprising 2-methyl-2,4-dicyclohexylpentane, which is close to the claimed 1,4-dicyclohexyl-4-methylpentane of the presently claimed invention.
The closest art references disclose traction fluids with known dimers of styrene. However, the closest art reference(s) alone and/or in combination fails to teach or suggest the claimed lubricating oil composition with both of the claimed structures in a single lubricant formulation.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
Hagemeister et al. (US 2010/0048434) discloses in the abstract, a basestock that comprises a fully hydrogenated substituted styrene linear dimer; a partially hydrogenated mono-aromatic substituted styrene linear dimer; and a partially hydrogenated di-aromatic substituted styrene linear dimer. A process of producing a basestock that comprises reacting a feed stream that comprises substituted styrene, alcohol, and a dimerization catalyst, in the presence of a solvent, to form a crude slurry of dimerized substituted styrene; and partially hydrogenating the dimerized substituted styrene with hydrogen over a Group VIII catalyst to form a basestock that comprises a fully hydrogenated substituted styrene linear dimer and a partially hydrogenated substituted styrene linear dimer.
Wygant (US 3,994,816) discloses in the abstract, an improved method of transmitting power in hydraulically-operated mechanisms which comprises using as the operative fluid substantially completely hydrogenated dimers of alpha-methylstyrene, e.g. 2,4-dicyclohexyl-2-methylpentane.
