Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 101
35 U.S.C. 101 reads as follows:
Whoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefor, subject to the conditions and requirements of this title.
Claims 14 and 19 are rejected under 35 U.S.C. 101 because the claimed invention is directed to non-statutory subject matter. The claim(s) does/do not fall within at least one of the four categories of patent eligible subject matter because the claims are directed to a program per se. A program per se is not a process, a machine, an article of manufacture, or a composition of matter.
Allowable Subject Matter
Claims 1-13 and 15-18 are allowed.
The following is a statement of reasons for the indication of allowable subject matter: the prior art, either alone or in combination, fails to teach or suggest a building interior structure recognition method and system for recognizing a structure inside a building, comprising “removing an image of a noise component from the image inside the building acquired in the scanning step”, “using an image from which the noise component is removed and which is obtained in the removing step to carry out relearning with respect to the first machine-learned model, and generating a third machine-learned model”, “using the third machine-learned model to recognize the structure inside the building”, and “extracting and outputting point cloud data of the structure inside the building recognized in the recognizing step from the 3D point cloud data acquired in the scanning step”.
The closest prior art of record is as follows:
Ito et al (US 2026/0017933 A1) discloses a building inside structure recognition system and method in a machine-learned model based on BIM data is relearned through a second machine-learned model based on imaging data.
Cheah et al (US 2023/0236608 A1) discloses a method and system for inspecting a building construction site through a mobile robot with sensor using BIM information and a trained object detection system employing a neural network.
Lopez Gavilan et al (US 2022/0366646 A1) discloses a computer vision system for determining structure features from point cloud data using neural networks.
Fukuma et al (US 2021/0279960 A1) discloses a system and method for photogrammetry of a building using machine learning based inference.
Marra et al (US 2017/0206648 A1) discloses a system and method for structural inspection and construction estimation using an unmanned aerial vehicle.
