Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 3-4 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claims 3-4 recite the limitation "the number of times". There is insufficient antecedent basis for this limitation in the claim.
Best Applicable Prior Art
Regarding independent claim 1, the closest prior art Han et al., US 10348796 is interpreted as disclosing: A communication system comprising: a transmission device that includes a transmission-side processor, a transmission-side memory which stores an instruction executed by the transmission-side processor, a first transmission-side communication interface, and a second transmission-side communication interface and transmits a plurality of pieces of frame data included in streaming data of content; and a reception device that includes a reception-side processor, a reception-side memory which stores an instruction executed by the reception-side processor, a first reception-side communication interface, and a second reception-side communication interface and that receives the plurality of pieces of the frame data from the transmission device, wherein the first transmission-side communication interface communicates with the first reception- side communication interface, the second transmission-side communication interface communicates with the second reception-side communication interface.
The prior art is interpreted as failing to disclose: the reception-side processor generates, in a case where the reception-side processor is in a multi-communication state in which the plurality of pieces of the frame data are received through use of both the first reception-side communication interface and the second reception-side communication interface, a control signal for switching to a single- communication state in which the plurality of pieces of the frame data are received through use of one of the first reception-side communication interface and the second reception-side communication interface that is selected on a basis of communication quality, the reception-side processor generates, in a case of the single-communication state, the control signal for switching to the multi-communication state on the basis of the communication quality of one of the first reception-side communication interface and the second reception-side communication interface that receives the plurality of pieces of the frame data, and the transmission-side processor uses one of or both the first transmission-side communication interface and the second transmission-side communication interface on a basis of the control signal to cause the plurality of pieces of the frame data to be transmitted.
Regarding independent claim 10, the closest prior art Han et al., US 10348796 is interpreted as disclosing: A reception device comprising: a reception-side processor; a reception-side memory that stores an instruction executed by the reception-side processor; a first reception-side communication interface; and a second reception-side communication interface, wherein the reception device receives, from a transmission device that includes a transmission-side processor, a transmission-side memory which stores an instruction executed by the transmission-side processor, a first transmission-side communication interface, and a second transmission-side communication interface and that transmits a plurality of pieces of frame data included in streaming data of content, the plurality of pieces of the frame data, the first reception-side communication interface communicates with the first transmission- side communication interface, the second reception-side communication interface communicates with the second transmission-side communication interface.
The prior art is interpreted as failing to disclose: the reception-side processor generates, in a case where the reception-side processor is in a multi-communication state in which the plurality of pieces of the frame data are received through use of both the first reception-side communication interface and the second reception-side communication interface, a control signal for switching to a single- communication state in which the plurality of pieces of the frame data are received through use of one of the first reception-side communication interface and the second reception-side communication interface that is selected on a basis of communication quality, and the reception-side processor generates, in a case of the single-communication state, the control signal for switching to the multi-communication state on the basis of the communication quality of one of the first reception-side communication interface and the second reception-side communication interface that receives the plurality of pieces of the frame data.
Regarding independent claim 11, the closest prior art Han et al., US 10348796 is interpreted as disclosing: A transmission device comprising: a transmission-side processor; a transmission-side memory that stores an instruction executed by the transmission-side processor; a first transmission-side communication interface; and a second transmission-side communication interface, wherein the transmission device transmits, to a reception device that includes a reception-side processor, a reception-side memory which stores an instruction executed by the reception- side processor, a first reception-side communication interface, and a second reception-side communication interface and that receives a plurality of pieces of frame data included in streaming data of content, the plurality of pieces of the frame data, the first transmission-side communication interface communicates with the first reception- side communication interface, the second transmission-side communication interface communicates with the second reception-side communication interface.
The prior art is interpreted as failing to disclose: in a case of a multi-communication state in which both the first transmission-side communication interface and the second transmission-side communication interface are used to transmit the plurality of pieces of the frame data, when a control signal for switching to a single-communication state in which one of the first reception-side communication interface and the second reception-side communication interface that is selected on a basis of communication quality is used to receive the plurality of pieces of the frame data is received, the transmission-side processor uses, on a basis of the control signal, one of the first transmission-side communication interface and the second transmission-side communication interface to cause the plurality of pieces of frame data to be transmitted, and, in a case of the single-communication state, when the control signal for switching to the multi-communication state on the basis of the communication quality of one of the first reception-side communication interface and the second reception-side communication interface that receives the plurality of pieces of the frame data is received, the transmission- side processor uses, on the basis of the control signal, both the first transmission-side communication interface and the second transmission-side communication interface to cause the plurality of pieces of frame data to be transmitted.
Any comments considered necessary by applicant must be submitted no later than the payment of the issue fee and, to avoid processing delays, should preferably accompany the issue fee. Such submissions should be clearly labeled “Comments on Statement of Reasons for Allowance”.
