1 The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 112
2 The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 9 and 10 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 9, recites the following limitations “a laundry detergent composition according to claim 1” and “the laundry detergent composition”. There is insufficient antecedent basis for these limitations in the claim. Claim 1 recites “An aqueous laundry detergent composition” and does not recite “a laundry detergent composition”. Correction is required.
Claim 10, recites the following limitation “the aqueous laundry detergent composition”. There is insufficient antecedent basis for this limitation in the claim. Claim 9 recites “a laundry detergent composition” and does not recite “an aqueous laundry detergent composition”. Correction is required.
The examiner suggests the amendment of claim 9 by reciting “an aqueous laundry detergent composition” and to cancel claim 10.
Claim Rejections - 35 USC § 102
2 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
3 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claims 1-10 are rejected under 35 U.S.C. 102(a)2 as being anticipated by Stephen et al. (EP 4256011 B1).
Stephen et al. (EP’ 011 B1) teaches an aqueous liquid laundry detergent composition comprising anionic surfactants include C12-C14 alkyl ether sulfate having a branched chain alkyl group having 12 to 14 carbon atoms and containing 1 EO unit molecule represented by sodium lauryl ether sulfate (SLES) having the following formula:

Wherein n is 1EO unit as claimed in claim 1 (see page 4, paragraph, 0040), wherein the anionic surfactant does not contain 1,4-doxane as claimed in claim 2, and does not contain branched alcohol sulfate surfactant of the claimed formula (II) as claimed in claim 4. Stephen et al. (EP’ 011 B1) an aqueous laundry detergent composition comprising same anionic surfactant of alcohol ethoxysulfate which inherently should have same elevated thermal stability as claimed in claim 3. The aqueous laundry detergent composition also comprises water in the amount of from 50% (see page 6, paragraph, 0067), wherein the aqueous laundry detergent composition also comprises at least 10% wt., of the total alkyl ether sulfate (anionic surfactants) (see page 5, paragraph, 0051) and wherein the weight ratio of the nonionic surfactant to anionic surfactant is 2:1 to 1:6 as claimed in claim 5 (see page 4, paragraph, 0036), wherein the aqueous laundry detergent composition also comprises ethanol and n- or i-propanol (organic solvents) as claimed in claim 6 (see page 8, paragraph, 0091), wherein the laundry detergent composition also comprises additional anionic surfactants include linear alkylbenzene sulfonate surfactants as claimed in claim 7 (see page 4, paragraph, 0043), and wherein the aqueous laundry detergent composition also comprises hydrotropes as claimed in claim 8 (see page 8, paragraph, 0091). Stephen et al. (EP’ 011 B1) also teaches a method for washing textiles, comprising treating textiles with an aqueous solution of the detergent composition as claimed 9 and 10 (see claim 14). Stephen et al. (EP’ 011 B1) teaches all the limitations of the instant claims. Hence, Stephen et al. (EP’ 011 B1) anticipates the claims.
