Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Priority Receipt is acknowledged of certified copies of papers required by 37 CFR 1.55. Information Disclosure Statement The information disclosure statement (IDS) submitted on 03/05/25 and 04/22/25 have been considered by the examiner. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 2-8, 10-16 and 18 rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. In claim 2, line 4, the phrase “sealing of the coating color layer S1 against the coating color layer S1” does not make sense. Clarification is required. Claims 2-8, 10-15 and 18 all use the phrase “preferably” followed by a limitation or the phrase “in particular” followed by a limitation. It is unclear whether the broad or narrow ranges are being claimed. Clarification is required. Claim 16 is dependent upon claim 15 and is therefore rejected. Allowable Subject Matter Claims 1 and 9 are allowed. The following is an examiner’s statement of reasons for allowance: The claims are allowable because the prior art does not teach or suggest a barrier paper having a coated layer on a base paper where the coated layer is formed of at least one polymer binder and at least one wax and is subjected to a temperature treatment at 105C for 3 minutes resulting in at least one of conditions a) through c). The cited art disclose barrier papers having a coating comprising a polymer binder and wax but do not disclose subjecting the coated paper to the thermal treatment at exactly 105C for exactly 3 minutes to achieve the surface tension properties claimed. Any comments considered necessary by applicant must be submitted no later than the payment of the issue fee and, to avoid processing delays, should preferably accompany the issue fee.
