CTNF 19/112,974 CTNF 82202 DETAILED ACTION Notice of Pre-AIA or AIA Status 07-03-aia AIA 15-10-aia The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA. Claim Rejections - 35 USC § 101 07-04-01 AIA 07-04 35 U.S.C. 101 reads as follows: Whoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefor, subject to the conditions and requirements of this title. Claim16-18 are rejected under 35 U.S.C. 101 because the claimed invention is directed to non-statutory subject matter. The claim(s) does/do not fall within at least one of the four categories of patent eligible subject matter because the claim recites a program without a medium As the courts' definitions of machines, manufactures and compositions of matter indicate, a product must have a physical or tangible form in order to fall within one of these statutory categories. Digitech, 758 F.3d at 1348, 111 USPQ2d at 1719. Thus, the Federal Circuit has held that a product claim to an intangible collection of information, even if created by human effort, does not fall within any statutory category. Digitech, 758 F.3d at 1350, 111 USPQ2d at 1720 (claimed "device profile" comprising two sets of data did not meet any of the categories because it was neither a process nor a tangible product). Similarly, software expressed as code or a set of instructions detached from any medium is an idea without physical embodiment. See Microsoft Corp. v. AT&T Corp., 550 U.S. 437, 449, 82 USPQ2d 1400, 1407 (2007); see also Benson, 409 U.S. 67, 175 USPQ2d 675 (An "idea" is not patent eligible). Allowable Subject Matter 12-151-07 AIA 07-97 12-51-07 Claim s 1-15, 19 are allowed. 13-03-01 AIA The following is a statement of reasons for the indication of allowable subject matter: Claim1 recites a solid-state imaging device comprising : a light source that is provided on an opposite side of a display surface of a display and emits light in an infrared light band via the display; a first light receiving region that is provided on an opposite side of the display surface of the display and includes a pixel that receives light in a visible light band and a pixel that receives at least light in an infrared light band emitted from the light source; and a second light receiving region that is provided on an opposite side of the display surface of the display and includes a pixel that receives at least light in an infrared light band emitted from the light source . Claim14 recites an electronic apparatus comprising: a display that displays information; a light source that is provided on an opposite side of a display surface of the display and emits light in an infrared light band via the display; a first light receiving region that is provided on an opposite side of the display surface of the display and includes a pixel that receives light in a visible light band and a pixel that receives at least light in an infrared light band emitted from the light source; a second light receiving region that is provided on an opposite side of the display surface of the display and includes a pixel that receives at least light in an infrared light band emitted from the light source; a processing circuit that performs authentication processing using an infrared light image acquired by a pixel belonging to the first light receiving region and a depth image acquired by a pixel belonging to the second light receiving region . The closest prior arts, Holenarsipur et al US 2019/0080668, either singularly or in combination fails to anticipate or render the underlined limitations obvious.
