Office Action

§112
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Priority Receipt is acknowledged of certified copies of papers required by 37 CFR 1.55. Information Disclosure Statement The information disclosure statement (IDS) submitted on 3/19/2025 has been considered by the examiner. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-4 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim 1 recites “the other end” in lines 5-6, which lacks antecedent basis in the claims. Claim 1 recites “a recirculation trajectory of the recirculation groove is formed on the basis of a groove cross-sectional trajectory curve representing a trajectory along which the balls are recirculated in a groove cross-section of the ball screw shaft, and a longitudinal trajectory curve representing a trajectory along which the balls are recirculated in a virtual plane” which is generally unclear and renders the claims indefinite. Specifically, it appears the claim is attempting to define a trajectory by basing it on other trajectories that are in themselves, representing another trajectory. This series of dependent trajectories make it impossible to determine what trajectory/trajectories the claim is requiring. Claim 1, lines 12-14 associate the reference character “Fv(ω)” with “a helical trajectory length of the longitudinal trajectory curve from a start point”” and “a helical trajectory length of the recirculation trajectory of the recirculation groove from the turn start point”, which renders the claims indefinite. Similar recitations associated with “Fn(ω)” in lines 15-17, and “Fb(ω)” in lines 18-20 are likewise indefinite. Allowable Subject Matter Claim 1 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action. Claims 2-4 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action and to include all of the limitations of the base claim and any intervening claims.
