Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claim(s) 1, 6, 10 and 12 is/are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Daniluk et al. (US 3,217,861).
Daniluk et al. show a curved belt conveyor having inner and outer profiles, an endless belt 40 that is mounted on two rollers 15 and 30, at least one curved guide 10 which includes slots which are defined by flanges 51 (see Figure 6) and cleats 60 which include lugs that extend into the slots so as to guide the belt.
Re claim 6, each cleat 60 includes a base body and laterally extending portions which extend from the base body.
Re claim 10, the lug 60 is integrally formed from a single piece.
Re claim 12, shown is a hole which receives a fastener.
Allowable Subject Matter
Claims 2-5, 7-9, 11 and 13-16 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
