Office Action

§112
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Drawings The drawings are objected to as failing to comply with 37 CFR 1.84(p)(5) because they do not include the following reference sign(s) mentioned in the description: 34. Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. Specification The disclosure is objected to because of the following informalities: The specification recites “union nut interface 23” and “union nut interface 34”; however, both statements cannot be correct. The specification recites phrases such as “in claim 1”. However, the specification is intended to support and breathe life into the claims, and not vice versa. Appropriate correction is required. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-18 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claims 1 and 10 recite “it”; however, it is not clear to the Examiner exact what “it” is referencing. Regarding claims 3, 4 and 6, the phrase "preferably" renders the claim indefinite because it is unclear whether the limitation(s) following the phrase are part of the claimed invention. Claim 8 and 14 recite “its”; however, it is not clear to the Examiner exact what “its” is referencing. Claims 8 and 13 recite, “the connection module is connected to a function module”; however, it is not clear to the Examiner how the connection module can be a function module. Allowable Subject Matter Claims 1 and 10 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action. Claims 2-9 and 11-18 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action and to include all of the limitations of the base claim and any intervening claims. The following is a statement of reasons for the indication of allowable subject matter: The prior art does not disclose a connector module for fluidly connecting a fluid system to a function module, comprising a housing with at least one fluid port and at least one connector fluidly connected to the fluid port, the connector comprising an adaptor, a union nut, a union nut interface, a metal gasket and at least one O-ring, wherein the metal gasket is deformed by the union nut pressing it via the adaptor against the union nut interface and the metal gasket fluidly seals the adaptor to the union nut interface, wherein the adaptor and the union nut interface comprise a protrusion and a recess for pressing against the metal gasket. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure because it illustrates the state of the art. Any inquiry concerning this communication or earlier communications from the examiner should be directed to AARON M DUNWOODY whose telephone number is (571)272-7080.
