Office Action

§102
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim(s) 13 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Erickson et al. (10435227). Regarding claim 13, Erickson discloses an adapter for removably coupling a dispenser system to a pressurized container assembly to enable the dispenser system to dispense pressurized product from the pressurized container assembly, the adapter comprises: a container adapter component (60) configured to be secured to an upper portion of the pressurized container, the container adapter component including an outer upper annular portion (61) and an inner upper annular portion (110) disposed radially inward of and generally opposing the outer upper annular portion to define an annular space; and a dispenser adapter component (70) configured to be coupled to tubing of the dispenser system, the dispenser adapter component including an internal stem coupler (81) configured to be fluidly and mechanically coupled to the valve stem, and an annular, depending flange (72) configured to be received in the annular space of the container adapter component. Allowable Subject Matter Claims 1-12 are allowed. Claims 14-17 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. The following is a statement of reasons for the indication of allowable subject matter: The closest prior art to the claimed invention is Erickson. Erickson fails to teach or suggest a dispenser system including a spray gun, and tubing in fluid communication with the spray gun; wherein the dispenser adapter component is removably secured to the container adapter component by twist-locking, in which rotation of the dispenser adapter component relative to the container adapter component selectively locks and unlocks the dispenser adapter component relative to the container adapter component and axially translates the internal stem coupler, and in turn the stem of the valve, relative to the pressurized container to selectively open and close the valve assembly.
