Office Action

§112
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Priority Receipt is acknowledged of certified copies of papers required by 37 CFR 1.55. Drawings The drawings are objected to under 37 CFR 1.83(a). The drawings must show every feature of the invention specified in the claims. Therefore, the gap must be shown or the feature(s) canceled from the claim(s). No new matter should be entered. Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-20 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. For claim 1, it is unclear whether or not the cabinet with its opening and cavity receiving a server therein is to be claimed in combination with the sever installation structure. In the preamble of the claim, the cabinet and server appear in intended use statements and therefore are not positively claimed. However, in the body of the claim, the cabinet and server are positively claimed in relation to the server installation structure. See paragraph 2 of claim 1 (e.g.” side surfaces of the server are respectively connected to the slide rail” and “the slide rail extends along a direction from the opening to interior of the accommodating cavity (of the cabinet)”). For examination purposes, the combination will be considered the claimed subject matter. Furthermore, for claim 1, it is not specified how the locking modules move from one locked/unlocked state to the other, i.e. is it unclear what features they abut with/disengage from, even though the actions/both positions are claimed. Note: the brackets that act on first locking module are not claimed until claim 20 and the second locking module/columns interaction is not disclosed in any of the claims. In order for the locks to function, these members would need to be referred to in some manner in the claim. Allowable Subject Matter Claim 1 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action. The prior art fails to teach a server installation structure used to install a server within the cavity of a cabinet, the structure comprises a first locking module, a second locking module and a slide rail; two opposite side surfaces of the server are respectively connected to the slide rail, the slide rail extends along a direction from an opening to an interior of the cavity, and the first and second locking modules are arranged on the slide rail at intervals along the direction, and both modules are switched between a locked state and an unlocked state; the first locking module comprises a first elastic piece, a locking member and a first spring, and the second locking module comprises a second elastic piece, wherein the first elastic piece is partially fixed to the slide rail, and a first gap is provided between the first elastic piece and the slide rail; the locking member is rotatably connected to the slide rail; one end of the first spring is connected to the first elastic piece; the other end of the first spring is connected to the locking member; and the second elastic piece is partially fixed to the slide rail; and an included angle is formed between a part of the second elastic piece and the slide rail; the second elastic piece is provided with a barrier member; and when the first locking module is in the locked state (via abutment with a bracket), a part of the locking member is located in the first gap, and the first spring is in a tension state; when the first locking module is in the unlocked state, the locking member is located outside the first gap, and the first spring is restored to an initial state; when the second locking module is in the locked state (via abutment with a column), the included angle is a first angle, and the barrier member is far away from the slide rail; when the second locking module is in the unlocked state, the included angle is a second angle, and the barrier member is close to the slide rail; wherein the first angle is greater than the second angle. Claims 2-20 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action and to include all of the limitations of the base claim and any intervening claims. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
