DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 112
1. The following is a quotation of 35 U.S.C. 112(b):
(B) CONCLUSION. The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
2. Claims 1-20 are rejected under 35 U.S.C. 112(b), second paragraph, as being vague and indefinite for failing to particularly point out and distinctly claim the subject matter which applicant regards as the invention for the reasons stated below.
Claims 1 and 16 recite “the hyperspectral images” without any antecedent basis for any hyperspectral images being obtained from the imaging of an area.
Claims 1 and 16 also recite “at most h_HS successive lines”. The term “at most” is vague and indefinite since the Examiner is unsure of the meets and bounds of “at most”.
Claims 1 and 16 also recite “the hyperspectral zone” without any antecedent basis for any hyperspectral zone and what that zone encompasses.
Claims 3, 9, and 17 recites “the observed scene” without any antecedent basis for any scene.
Claims 1-2, 4-8, 10-15, and 18-20 are rejected for being dependent upon a claim rejected under 112 (b).
Allowable Subject Matter
3. Claims 1-20 contain allowable subject matter and would be allowable upon overcoming the above 112(b) rejections(s).
